Q: My new main bedroom was installed a few days ago. Upon placing the order, the company I bought the bedroom from gave me the measurements of the mattress I should buy. After installing the bed, the new mattress did not fit.
Is the company responsible for giving me the wrong size? What are my legal rights in this situation?
A: Since it is the company that gave you the wrong mattress size, legally it is their responsibility to provide a solution to this problem. Ideally, however, you have the size of the mattress in writing in the contract of sale. If this is not the case, and if the company denies it has given you that particular size, it’s basically their word against yours.
At this point, the first thing you should do is ask the company if it is willing to exchange it with a different size. If the answer is no, then you should ask the company where you bought the bedroom from to either provide you with a suitable mattress of the same quality, or give you a refund, so that you can buy a new mattress without incurring any extra costs.
If you do not manage to obtain a suitable redress from the bedroom’s seller, youcan file a complaint with the Office for Consumer Affairs.
