Żebbiegħ murder: Accused granted bail on ninth attempt
Kenneth Gafa, 39, of Marsa, who stands charged with the fatal shooting of his former partner outside Żebbiegħ (Mgarr) two years ago, was granted bail today.
It was his ninth request for bail.
Mr Gafa has been under preventative arrest since December 2010 after he was charged with the murder of Christine Sammut, who was shot in the neck and chest, in Żebbiegħ while she was in the driver’s seat of a van.
Two spent shotgun cartridges were found on the ground, one next to the driver’s door and the other close to the bonnet.
Previous requests for bail were turned down as the prosecution argued that he was a high-risk individual especially because he had nothing to keep him tied down to Malta.
Bail was today granted against a deposit of €15,000 and a personal guarantee of €25,000.

the court cannot deny bail,only in exceptional circumstances can it deny bail........... Bail does not mean you got away with murder!....A person is presumed innocent until proven guilty........
What people should be angry about is the delay it takes the court to try a case......That I agree.....
But in our country where a trial can take five years to be tried, God forbid if we had no bail.!!!!!

There should be a very good explanation why this case has not been tried in Court and he either be found not guilty or sentenced. Justice delayed is justice denied both for the accused and the friends and relatives of the victim.

Shameful again.. why granted bail in the ninth time.. bah, it should have been given ages ago if it were correct, so why is it now?

This is a joke!!!! A man I know got 7 years in jail and a hefty fine after being found in possesion of a large ammout of cannabis. He was sentenced the day after the find and it was a public holiday so the courts had to open specifically for his case to be heard. But this man....well he murdered a friend of ours and left a 15 year old girl motherless and two years later not even a date for the trial has been set!!! What is wrong with this damn country??? And to hell with all the innocent till proven guilty crap......he walked into a police station and confessed to the crime! Stupid.....our court system is simply stupid!!!

The Maltese laws just give you one option: use your imagination to make justice. According to LAW a person who was killed does no longer enjoy human rights.....the person who committed the crime is still alive and continues to enjoy the human rights.

Most often the presumption of innocence is claimed by counsel when requesting bail. This is based on the premise that unless proven guilty, a person should not be punished for an alleged offence. But this cannot be more fallacious. While "detention" is there to keep a dangerous person off the streets (much like keeping a lion caged), a sentence of "imprisonment" is given to punish a person. If the courts, counsel and legislators cannot understand the difference in the two concepts which are clearly explicated in the Criminal Code, Cap. 9, who then really can?

Bail is set according to ones means..... So if a judge can set bail at 1 million euros to an individual and 10000 euros to another accused with same crime........Remember that a 1000 euros for a lower income person could be as hard or harder to come up with 100000 to a middle class citizen....

Can someone please explain to me what they mean when they say Bail was today granted against a deposit of €15,000 and a personal guarantee of €25,000. Did the accused have to pay 15,000 cash and then have a guaranteed sum of 25,000 locked in the bank or something? and what are the actual bail conditions? Either way 2 years and 40K to Murder somebody are a joke.

People here don't seem to understand what the word "bail" means. All it means is that the accused will not be detained until the court case actually starts. Because it can take years for something like this to get to court, the accused is given the option to pay some money and be allowed to live his life until his court date comes up.
