Five admit Marsaxlokk brawl, fined €60 each
The five men were taken to court before the building was opened.
Updated - Five men were this afternoon fined €60 each after pleading guilty to breaching public order and assaulting a man during an incident at Il-Maghluq, Marsaxlokk, yesterday
The incident took place during a protest by residents over the way campers were 'taking over' a small beach at Il-Magħluq.
Anthony Cini, 37 of Fgura, Gerson Orsini, 24 of Vittoriosa, Stephen Debono, 44 of Zabbar, Francis Debono, 69 of Cospicua and Mario Schiavone 40 of Cospicua were taken to court in a police van.
All pleaded guilty to slightly injuring Christopher Haber and swearing in public.
The court was told that Mr Haber had forgiven them.
Mario Schiavone also admitted to committing the crime during the operative period of a suspended jail term.
Magistrate Antonio Micallef Trigona extended the suspended jail term for Mr Schiavone by another two years.
He also warned all the accused not to approach or harass the victim.

come on guys for god sake, why are you doing all this fuss on this case where noone even know the whole story, you are all making your opinons based on some thing that you only know what you heard of assums. this was an argument that everyone involved even the 'victim' himself admited that it was some thing that could be resolved easlly. there was too mant things and miss understanding that happened in this case but because there was new everybody is trying to push it so high. as i read and heard today that the Authory general should appeal from this sentence. for the sake, if the AG appeal from this case he will have to appeal from all sentences that will be considered as slight. do not forget that the accuse act was about slight injury and swearing in public. and the plaead guilty and the forgivness so what more? you know the benefit of article 29? what can be done more, for me the judge still kept defending the victme by imposing a € 1300 as a personal garantee so this will not happen again. so what you want more? hehe when i see these comments here i will be in doubt if we have the angels running every where in this country because by words every body says what think to show how nice he looks. one have to consider that this was an illigal protest from the start that happened to become a slight fight. SO! are we living in garden of Eden now? come on lets give this theme a break and who ever want to judge others first he try to judge himself.

once they even fined my father for lm25 because the magistrate said cauchi instead of gauci and he didn't stand up...
and these guys went in court with those type of clothes (when police usually send people back home to change in decent clothes) , illegal camping and got into a fight ..for the same amount of money...

From a cost-benefit point of view, it's worth beating the crap out of somebody you dislike for €60!! It's also great for stress relief, and what more does one wish for... it's even sanctioned by the Courts at €60 a head. Shameful for a country that aspires to be a part of civilized Europe... the sort of thing one expects in central Africa!

Eur 60 each and an extension of a suspended sentence?? AND they are allowed to camp on! Please excuse the comment BUT anyone who does not understand WHY the courts are derided must be thick!
Great use of my taxes by the way....their fine should have included all the expenses incurred by the police corps, courts etc....but what the hell....keep the improved pay packages coming and forget about accountability and duty. Lets not blame the archaic law shall we? We are actually paying those who make or change the law but instead are simply encouraging a culture where the law of the jungle reigns supreme. By the way where are the chest thumping big shots from both sides of the political divide who have Malta's best interest at heart? Any comments from them?

Are we serious here in Malta? Is it the law or the court? In my humble opinion how can a violent act like that carry a euro 60 fine? And how is it that somebody who is already on a suspended sentence get off by getting and extension and not made to serve the sentence? After all the individual was found guilty of another crime.
Will the police allow these people to continue to occupy this beach with their tents? As far as I know the regulations are that only umbrellas can be pitched on beaches and they have to be removed by sunset.
As someone has said earlier on this wall, if one has a score to settle with somebody, for euro 60 it is worth to take the law in one's hand.

I agree with your first comment. Pitiful! Even if the courts are correct in passing this sentence, JUSTICE MUST NOT ONLY BE DONE BUT JUSTICE MUST BE SEEN TO BE DONE!

if i'm not mistaken this is the maximum fine offered by our law when one punches someone else, remember when once an ex-policeman was hit by someone in republic street, he was fined 25 Maltese liri (approx 60 euros) so its not the fault of the magistrate but the law. and as someone said its worth hitting your opponent for that price.
no wonder they looked so confident...they already knew what was going to happen. as for the clothes I cannot understand, once I was going in for a parking ticket and just because my suit jacket was open the magistrate was going to fine me.(had to button it completely)
it seems these people were right and not all of us......

And you extend his suspended sentence? hmmmm... i thought the whole scope of a suspended sentence was so as not to repeat any crimes? Obviously i was wrong... Let's all go out and beat up people infront of families and kids and set up fine examples of mature adults. This sentencing is an insult to anyone's intelligence. What a joke Malta has become.

Our law courts have become a joke!!! €60 for bullying with one of them committing a crime during the operative period of a suspended jail term!!! Well done to the magistrate for this and for letting these people present themselves in court as if they were off to the beach!!! Had any ordinary citizen done the same he would get a heftier fine for bullying, a fine for inappropriate clothing and anyone with a suspended sentence would have been thrown in jail!!!!! Is this why the magistrates will be given a wage rise off the backs of the tax payer????? On this alone i would reprimand the magistrate himself because this is a gross miscarriage of justice.

How much overtime was paid to the court officers to re-open the courts? Was it that necessary to re-open the court for this only? Or the accused made a deal with the Police that they would be pleading guilty if taken to the court in the afternoon, so they don't miss a day from the Camps? Moreover, has this cost us more than the 300 euro sentence given by Magistrate Antonio Micallef Trigona in wages to the court officers, police, etc etc?

this sentence should be reviewed and contested by the attorney general, one because the fine is ridiculously low and two because in one of the five cases, the person was on a suspended sentence. The AG should also investigate if the camps can indeed be set up and rule to the clearance of these camps with immediate effect.

The magistrate "extended the suspended jail term .......... by another two years". This is unheard of! Ridiculous! The accused admitted to committing the crime during the operative period of a suspended jail term. This should have made the suspended jail term immediately operative and never extended!
"The court was told that Mr Haber had forgiven them" and all the accused admitted (legal farce) ---- this concoction brought about the ridiculous sentence because our courts tend to go by the book.

what a farce....once when i had a case at the local council courts, a guy next to me came without the suit and the judge made him go home and wear properly....and these five thugs....they came straight from the beach to court and all they get is a 60 euro fine...this is such a farce ! Today is one of those times that I really feel disgusted and ashamed that I am Maltese. This is at least shameful of our society and of our courts. With their decisions and sentences, the Maltese courts are urging criminals to do more crimes. The evidence could not be clearer. One also had a suspended sentence!
And how come the courts allowed them to make fun of the courts in front of the camera? And how come they were allowed to go in the court wearing bermudas, vests and flip-flops?? What a disgrace!

People could be heard on the video calling the accused 'purcinelli' (clowns). The authorities put on a 'tejatrin' (show). If people who behave like this aren't made to say 'ouch', they will make others say it. Clearly, though, these chaps do have power of a sort. Equally clearly, decent people don't have it. While condemning the bullying and violence unreservedly one has to ask whether this is the first time the illegal campers have used this beach site. I suspect that enforcement should have taken place summers ago. One also asks who should have been responsible for such enforcement and failed in his duty : is it MEPA , the Tourist Board, The Health Dept or the police. We seem to act only when incidents arise or when ordinary citizens are forced to take action which falls under the responsibility of the authorities. Another problem in such issues is that you cannot focus on the weakest whose only possible holiday is squatting and ignore all the other abusers who are spoiling and polluting some of our most beautiful beaches. There was some time ago a policy to construct official managed camping sites. This policy should be extended and those who cannot afford it should be given the opportunity of using such official camping sites at subsidized prices.

Some time back when we were under different times. We used to enter the Law courts with a jacket, if we did not have one we rented it, shirt and tie and long pants.
Seeing these fine breed of gentlemen entering the law courts with flip-flops, t-shirts, and shorts I assumed they will get a fine of 60 euro for contempt of court, before the court even open to hear the case.

Someone had compared Malta to a Mickey Mouse country in the past...guess nothing has really changed except that the law courts and the way the sentences and justice are meted out have absolutely no ratio or measure by which it is calculated. Do the judges/magistrates know the laws of this fair land? I very much doubt it. Of course, Mr Haber forgave his aggressor...does he really have a choice when he as a law abiding citizen does not get the protection we all deserve from persons like these.

Did we not have a similar incident in St. Julians a few days ago where the victim ended up dead. The victim here had to run for his life so he can consider himself lucky. The photo clearly shows that he is being choked and at the same time the victim is not reacting.
Where is the Attorney General, the chief justice, and the minister of justice.
Who is the law courts protecting here. The criminal or the victim. No wonder he forgave them. For sixty euros they will be back. One of them is even on a suspended sentence but that didn't even deter him.

The worst thing is not the 60 euro fine because at the end of the day a court has parameters to work to and until these are changed we either like it or lump it.
What worries me is the fact that at least one of these thugs was already on a suspended prison sentence and he violated that . He should have been sent down to serve his time for the previous and this offence.
This could have been a murder and a clear message should have been sent out by the court that this sort of behaviour will not be tolerated. Just because the victim got away with slight injuries and it is said he had forgiven them should not come into the equation. I wonder what would have been said if the victim had been somebody who just happened to be carrying a knife and fought back? Would he have been taken to court as well I ask ?

It is even more pathetic that MEPA has given them sixteen days to remove their camps from the public beach, LOL 16 days for removing a tent for heavens sake. It is a total farce. MEPA can demolish a built property in one day yet these get to stay on for another 16 days on PUBLIC LAND at the expense of the taxpayer, No wonder they are laughing themselves silly at this total mockery of justice. So they still get to enjoy their little sta maria holiday for the next 2 WEEKS camped on a public beach because all they got was a slap on the wrist of 60 euros fine.

No excuse, but I think these men were picked up unexpectedly and driven right to the court house. I don't think the police gave them an opportunity to put on a shirt and tie. Come as you are and the judge will decide if their attire was proper. I hope this is not another case of a Suspended Sentence alone. I hope the judge or magistrate has enough sense to make these thugs clean up some of our beaches as part of the sentence, especially the beach at Marsaxlokk. The rest is up to the Mayor, the Local Council and residents of Marsaxlokk.

This incident is all the fault of MEPA and the government who do absolutely nothing to protect our natural and historical environment until there is a puboic outcry. This beach should never have been allowed to become a camping site with all its degrading consequences. Next step will be to turn into a shanty town with both the PN's and LP's secret blessing.
By the way, I drove through Birgu yesterday and could not belive my eyes: one of those giant posters set up right in the middle of one of the historic gates, covering the central arch and the painting within the arch. Those who set it up are nothing less than barbarians and the party whose poster it is just shows what it thinks of our historical heritage. Imagine doing the same thing in front of the Arch de Triomphe or Marble Arch! Barbarians!

Ms Camilleri the PN and the PL both represent the incompetent government. And yes this is a huge political issue. This is Malta and everything we do is political. Why do you think all the illegal boathouses have utilities provided to them by the government? Maybe you are too young but that interprets VOTES. I would dare any politician or any party PN or PL to tackle this problem openly. I guarantee you that it will be the end of of one's political career. I believe there was an attempt to demolish Armier Village at one time but the Armier Squatters won. Maybe the courts should take over, but even our courts are somewhat corrupt. By the way PN and PL represent the people and that makes it a political issue.

Anyways this sentence is ridiculous! It becomes cheaper to fill a human’s face with punches than filling a slot punching machine – and for some nothing beats the real thing!
Parliament (and I mean politicians on both sides) need to come down hard on these squatters and make it illegal to set camp. Also wherever it is allowed to set camp, camps should be mobile on demand and of a minimum aesthetic standards!

Accused were arraigned by way of arrest, so they did not have the time to change although those mineral bottles should have been held at the entrance. I was surprised how the onlookers, followers, family members, call them what you like, were allowed to enter the Law Courts wearing short denim skirts and t-shirts

Yes both Political Parties are accomplices and responsible for most of this lawlessness around our coasts. But both parties have an agenda and that does not include the cleaning up our coasts of illegal camping sites because it would involve a loss of votes. So in the name of politics: " We are Maltese and we do as we please". And having a general election in the near future does not help.

Sooner or later, the government has to make a stand. Politicians and Political Parties have to stop making deals with the devil because sooner or later the devil will collect. Maybe not from us but from our children and grandchildren. Ponder on that thought Mr/Ms Politician. Don't let your towns be taken over by renegades and bullies. If you must have boathouses and tent camps they must be regulated by the authorities. We must get rid of these unregulated shanty towns and ghettos to protect our coasts. I commend the people of Marsaxlokk for doing something about it. Don't let a few bullies and thugs take over your town.

The govt and MEPA have to stop this illegal camping on public beaches, there is a private camp sites if they wish - but they have to PAY not use public land for free and deprice ordinary citizens of their beach space.

Well as usual they will be 'conditionally discharged', given a 'suspended sentence' or fined 50 euros breaking public peace.
In the meantime I bet the campers are still all camped at il-Maghluq.

The whole spectacle was simply disgraceful and amounted to bullying and violent assault. In addition, are there no laws against squatting, illegal occupation of the national foreshore, causing pollution for not having adequate and hygienic sanitary facilities, an illegal assembly of a number of persons (attruppament), more probably than not swearing and blaspheming in public, swearing and blaspheming in front of minors and quite probably a few more illegalities than I can currently think of. The full force of the law should be thrown against such disgraceful law breakers and flouters.
