Five admit Marsaxlokk brawl, fined €60 each

The five men were taken to court before the building was opened.

Updated - Five men were this afternoon fined €60 each after pleading guilty to breaching public order and assaulting a man during an incident at Il-Maghluq, Marsaxlokk, yesterday

The incident took place during a protest by residents over the way campers were 'taking over' a small beach at Il-Magħluq.

Anthony Cini, 37 of Fgura, Gerson Orsini, 24 of Vittoriosa, Stephen Debono, 44 of Zabbar, Francis Debono, 69 of Cospicua and Mario Schiavone 40 of Cospicua were taken to court in a police van.

All pleaded guilty to slightly injuring Christopher Haber and swearing in public.

The court was told that Mr Haber had forgiven them.

Mario Schiavone also admitted to committing the crime during the operative period of a suspended jail term.

Magistrate Antonio Micallef Trigona extended the suspended jail term for Mr Schiavone by another two years.

He also warned all the accused not to approach or harass the victim.

Oh is one of them your relative by any chance Mr Orsini??? They should have been fined 500 euros each and 100 euros a day their tent stays up occupying a public beach in my book!! Not get off with a 60 euros fine.

I agree with your first comment. Pitiful! Even if the courts are correct in passing this sentence, JUSTICE MUST NOT ONLY BE DONE BUT JUSTICE MUST BE SEEN TO BE DONE!

About your last comment, it is the prosecution (the police) who charge people and not the judges!

Excellent comment, Mr Abela. It's not just superb photography, capturing the rage, the aggressiveness, the shock, to perfection, it's also the result of sheer guts and razor-sharp promptness. I hope it's never published abroad, but that is international class photography.

Should not the Registrar be made to publish a full statement of the whole operation ?
We all know what the receipts are €300.
What have the costs amounted to ?
This is tax payers' money that is being administered, so the TAXPAYER HAS A RIGHT TO KNOW and someone else has the duty to oblige ! sic.

How very right you are Mr. Said. Disgraceful throughout, the dress, the fines, etc. What a mockery of our judicial system and regulations! The laws need updating before any rise is awarded to any legal person in my opinion. Franco Debono please take note.

Well said !!

taking your dog to the beach, leaving it clean for others to use, being careful of not being a nuisance to others - still € 4,500

taking matters in own hands, punching and bullying a person, swearing in public, ridiculing the courts with 'funny' gestures outside the courts, no proper attire in court (incl defending attorney!), minimizing police work, and still occupying a public area making it difficult for others to use - still € 60 !!!!

As someone once said - justice in Malta is strong with the weak, and weak with the strong !!!

Mr Joe Micallef

Aug 13th 2012, 19:40

Jeffry Mallia police enforce law magistrates apply law and parliament enacts law.

If you wish to point a "political" finger point it at all parliament - I bet my bottom penny that any law trying to make enforcement on squatters more effective would be thrown out of parliament faster than many idiots (just saw one on my way home) throw the plastic wrapping of cigarettes packets out of their car! Too many votes to loose on both sides

Aug 13th 2012, 21:56

It is even more pathetic that MEPA has given them sixteen days to remove their camps from the public beach, LOL 16 days for removing a tent for heavens sake. It is a total farce. MEPA can demolish a built property in one day yet these get to stay on for another 16 days on PUBLIC LAND at the expense of the taxpayer, No wonder they are laughing themselves silly at this total mockery of justice. So they still get to enjoy their little sta maria holiday for the next 2 WEEKS camped on a public beach because all they got was a slap on the wrist of 60 euros fine.

Philip Mizzi

Aug 13th 2012, 19:29

That's it Mr.Callejja we are afraid to go to the beach well it has been long now that we can't enjoy the beach. Swearing, littered beach you cant trust your kids playing and afraid to talk to them cause they are all family so if one comes for you another 20 come. Its unbelievable and i got a ticket from the traffic police and it was 50euro.MY GOD where are we heading. No body cares if you have power its ok

This country has no law enforcement, take the law into your own hands and you get what you want, take over public beaches and no one gives a damn because the MEPA, the Courts and the Police and the Council are toothless and do not want to rock any boats! Assault a person and get off with a paltry 60 Euros fine! I wouild have fined them for a swearing in public, B) threatning a person, c) attacking a person, D) illegally occupying a public area.

Ms. P.M Graham

Aug 13th 2012, 18:12

oh just what we need more people in jail for the taxpayer to look after.

How about some community service on top of that fine?

Just because these persons decided to use their fists doesn't mean their families have to suffer, but perhaps with some community service others will learn.

C Cassar

Aug 13th 2012, 18:38

Their families are having a nice summer in the those tents on the beach. They also deserve jail and a €5000 per family member since they know exactly that what they are doing is illegal. No sympathy for their families whatsoever. It's the only way to send the correct message dor these illegalities and violence.

GL Calleja

Aug 13th 2012, 18:45

Ms Graham I agree with you a hundred percent. I would have those thugs clean up beaches for the rest of the summer and of course ban them from ever erecting another tent camp on any beach, at least not without a permit.

No excuse, but I think these men were picked up unexpectedly and driven right to the court house. I don't think the police gave them an opportunity to put on a shirt and tie. Come as you are and the judge will decide if their attire was proper. I hope this is not another case of a Suspended Sentence alone. I hope the judge or magistrate has enough sense to make these thugs clean up some of our beaches as part of the sentence, especially the beach at Marsaxlokk. The rest is up to the Mayor, the Local Council and residents of Marsaxlokk.

Same thing on Comino.

Mr Andrew Camilleri

Aug 13th 2012, 17:59

Sandra Camilleri: yes I blame the government because it is inefficient and incompetent and has no respect for our natural heritage. Why should this camping site have been allowed to mushroom? What if the Sliema beaches were turned into a camping site, with human mess all around? Would you just smile and wave at them?

GL Calleja

Aug 13th 2012, 18:00

Ms Camilleri the PN and the PL both represent the incompetent government. And yes this is a huge political issue. This is Malta and everything we do is political. Why do you think all the illegal boathouses have utilities provided to them by the government? Maybe you are too young but that interprets VOTES. I would dare any politician or any party PN or PL to tackle this problem openly. I guarantee you that it will be the end of of one's political career. I believe there was an attempt to demolish Armier Village at one time but the Armier Squatters won. Maybe the courts should take over, but even our courts are somewhat corrupt. By the way PN and PL represent the people and that makes it a political issue.

Mr Joe Micallef

Aug 13th 2012, 18:23

Andrew Camilleri, you'd blame the government even if your tea goes cold!

Anyways this sentence is ridiculous! It becomes cheaper to fill a human’s face with punches than filling a slot punching machine – and for some nothing beats the real thing!

Parliament (and I mean politicians on both sides) need to come down hard on these squatters and make it illegal to set camp. Also wherever it is allowed to set camp, camps should be mobile on demand and of a minimum aesthetic standards!

Accused were arraigned by way of arrest, so they did not have the time to change although those mineral bottles should have been held at the entrance. I was surprised how the onlookers, followers, family members, call them what you like, were allowed to enter the Law Courts wearing short denim skirts and t-shirts

Aug 13th 2012, 18:32

Surely the Magistrate did not see this barbaric scene on the local media.

GL Calleja

Aug 13th 2012, 17:39

Yes both Political Parties are accomplices and responsible for most of this lawlessness around our coasts. But both parties have an agenda and that does not include the cleaning up our coasts of illegal camping sites because it would involve a loss of votes. So in the name of politics: " We are Maltese and we do as we please". And having a general election in the near future does not help.

GL Calleja

Aug 13th 2012, 17:49

Sooner or later, the government has to make a stand. Politicians and Political Parties have to stop making deals with the devil because sooner or later the devil will collect. Maybe not from us but from our children and grandchildren. Ponder on that thought Mr/Ms Politician. Don't let your towns be taken over by renegades and bullies. If you must have boathouses and tent camps they must be regulated by the authorities. We must get rid of these unregulated shanty towns and ghettos to protect our coasts. I commend the people of Marsaxlokk for doing something about it. Don't let a few bullies and thugs take over your town.

Francesca Abela

Aug 13th 2012, 18:26

The govt and MEPA have to stop this illegal camping on public beaches, there is a private camp sites if they wish - but they have to PAY not use public land for free and deprice ordinary citizens of their beach space.
