A forensics expert testified in court today that a man accused of a double murder in Marsascala was not the one who fired the first shot.

Brigadier (rtd) Maurice Calleja was giving evidence in the case where Joseph (Giuseppe) Cutajar who stands accused of the murder of Kevin Gatt, 32 of Ghaxaq  and Stephen Zammit, 32 of Fgura.

The shooting took place on March 15 in an underground complex of garages. Gatt died on the scene while Zammit succumbed to his injuries a few days later in hospital. Both were in a car.

Brig. Calleja said his investigations also showed that the gun from where the first shot was fired had later jammed and could not be fired any more.(He did not say how many shots were fired from it).

Mr Cutajar was granted bail against a deposit of €5,000 and a guarantee of €15,000.

The police had said soon after the incident that at least nine shots were fired by two types of firearms. Both firearms were semi-automatic.
