An insurance company has been ordered to make good for the medical expenses incurred by an elderly woman who was run over by a car while crossing a road in Birkirkara in 2005.

The car was driven by the late Vincent Galea.

Yvonne Spiteri told the First Hall of the Civil Court, presided over by Mr Justice Silvio Meli, that she had looked both ways before crossing Fleur De Lys Road and had not seen any vehicle approaching.

It did not appear that Mr Galea had hooted his horn and neither were there any brake marks on the road.

Mr Justice Meli said that it appeared that Mr Galea, who died in the course of the litigation, had been driving at excessive speed and that he was responsible for the accident in which Mrs Spiteri had been seriously injured.

The court added that Mrs Spiteri had limited her claim for damages to that of reimbursement of the expenses she had incurred for medical treatment, which amounted to €17,406.93.

Elmo Insurance Ltd, Mr Galea’s insurers, were ordered to pay that sum to Mrs Spiteri.
