A man was yesterday declared to be the sole heir of his brother who was presumed dead after being lost at sea nearly 12 years ago.

Jason Muscat’s brother Paul disappeared after the speed boat he was on sank between Malta and Gozo. He had last been seen by Jason on October 12, 2000, the court heard.

On the day of the incident, Paul was on the speed boat with Jesmond Frendo Cumbo and Kevin Sammut.

The boat was shipwrecked in bad weather. Mr Frendo Cumbo was rescued and the lifeless body of Mr Sammut was recovered by the patrol boats.

However, Paul Muscat’s body was never found and there has been no sight of him since.

His brother therefore asked the court to declare that he was the sole heir as Paul was to be presumed dead.

Mr Justice Mark Chetcuti upheld the request.
