BirdLife insists it will continue to film illegal hunting
BirdLife insisted today that it will continue to film illegal hunting, when this is in the public interest.
It said that recent communication received from the Data Protection Commissioner did not, as the FKNK claimed, request that BirdLife Malta gains the consent of hunters before filming them or say that BirdLife Malta may not process such footage.
"The letter actually refers to only one incident where footage was released prior to the sentencing of an individual. The Commissioner deemed that BirdLife Malta had been acting in the public interest when publishing the video concerned, but that individuals ought not to be identifiable in such material."
BirdLife said the filming of individuals engaged in illegal acts or otherwise is not prohibited as long as the footage is taken in the interests of the public.
"The communication from the Data Protection Commissioner related to the person being identified and not to the actual filming of the incident. Footage gathered by BirdLife Malta involving illegal hunting and trapping is regularly passed on to the appropriate authorities and identities are disguised when footage is utilised for other purposes."
Last year, BirdLife Malta submitted over 100 investigation reports to the police including footage and photographs of individuals committing hunting and trapping offences.
BirdLife Malta also regularly receives reports and video material from members of the public which are passed on to the authorities for investigation purposes.
"There is no reason why BirdLife Malta, other NGOs and the public should not continue to report hunting and trapping illegalities by gathering video and photographic evidence to assist the police with their investigations," the society said.

On the same reasoning that FKNK are saying that it is illegal to film them, why don't we remove all CCTV cameras from the streets/shops/places of interest? it should be illegal in that way as well, or no?.....if you're doing something "legal" why should you not like to be filmed?..I, for one, would be glad to be filmed: it would show that I'm abiding to the law.....

ONE DOES NOT NEED CONSENT TO FILM AN ILLEGAL ACTIVITY? DOES ANYONE ASK FOR CONSENT WHEN FILMING CCTV FOOTAGE?

The solution is simple, if someone doesn't want to be filmed hunting illegally, then they should NOT hunt illegally!
We will not be bullied out of our national parks, out of enjoying peaceful moments in the countryside because some hunters think it's their right to hunt whenever they want and kill whatever they want.

This has nothing to do with the Data Protection Act - these 'hunters' are in the public domain and what has remained of our fields and wilderness to practice their 'hobby' and thereby depriving the rest of us of our rights to enjoy birdlife nature unmolested. The hunters lobby are a small minority but they are vocal and aggresive (mostly males) whereas the truth is that more then 90% percent of the Maltese are very politely telling them and our governmet that we are tired of being bullied - and for what, for the sake of a few votes. If the PN and PL were honest, they would not court the hunters but should come out in favour of the environment and nature and the rights of migratory birds and the majority of the Maltese and inform this aggresive lobby to take their votes and put them where the sun don't shine. But that didn't happen yet did it? This clearly show that our politicians are ready and willing to be bribed, just as long as they can come to or cling to power.

Thank you Birdlife Malta for your great work.
Being born and raised in Burmarrad I know exactly what hunting means in Malta. Shooting every bird in sight. I was once playing with my sister on our home roof when this beautiful bird passes nearly above us. A hunter shot it, a rain of pellets fell on me and my sister burning us, like tiny needles all over our bodies, and of course the bird was butchered to death with the pellets.
So keep up your great work and stop the bird massacre that is going on.

I honestly feel that so long as BIRDLIFE acts within the law and helps in curbing on illegal hunting whatever proof thay can provide whether it is filming or photoes is acceptable.
This is the only way that law abiding hunters may exercise their rights and stop being penalised for the wrong doing of poachers.
I encourage BIRDLIFE in their action, however, their findings have to be reported to the authorities and not splashed in the media tarnishing our country in the process.
Illegal activity has to be stopped and it is wrong of BIRDLIFE to make pressure to abolish hunting just because there are some who abuse.
The authorities have to implement the same principles where illegal activity is concerned whether it is hunting, drugs drinking etc.

there's a slight difference between using the videos and photos as evidence and sharing/ publishing them without the consent of the people filmed. and that slight difference is what the data protection act is about.

Hey Birdlife... If you want a good location to film this kind of stuff just come to the valley between Madliena and Gharghur on any day and at anytime... your intervention would be much appreciated as when i called the police on a number of occasions nothing was done... maybe if you bring your film crews over here i won't be woken up by the sounds of shotguns firing and pellets falling on my car... thanks
