Court orders continuation of case against GWU
The Court of Appeal has ordered the continuation of a case former General Workers' Union official Karmenu Vella had initiated against the union for the payment of three months wages and 193 days vacation leave.
The union had requested the court not to hear the case, which, it argued, should have been lodged with the Industrial Tribunal.
It appealed the decision of the first court given in September last year.
In its decision, the Court of Appeal declared that the tribunal's exclusive jurisdiction was just in certain cases of alleged unfair dismissal.
Lawyers Robert Abela and Lydia Abela appeared for Mr Vella.

As always not in my backyard. This is the same union that constantly accuses the employers and of course including the Govt of oppressing the workers. This is same union that should lead by example.
Such cases reveal the true faces of those who use the workers for their political ends.

This case speaks volumes about the General Workers Union, which is constantly moaning that workers' rights are being trodden. Here we have a case of a former GWU official who has taken the union to court simply because the union is allegedly refusing to pay him what is legally due to him..... Ara veru ma jisthux! Did you ever say this in your meetings in Brussels Mr Tony Zarb? Did you ever tell them that the General Workers Union is in court because it allegedly did not pay one of its former employees?
