Woman compensated for accident that took place 19 years ago
A woman injured while at work has been awarded over €19,000 in damages by the First Hall of the Civil Court.
The judgement, delivered by Mr Justice Anthony Ellul, was limited to the quantum of damages as the court had, in a judgment delivered in 2006, found Metalfit Co Ltd responsible for the damages suffered by Tania Sammut in 1992.
The court heard that Ms Sammut was employed by the company as a machine operator and that she had suffered an eight per cent permanent disability.
Mr Justice Ellul found that, on the basis of her injury and her salary.
She was to be awarded €19,950 in damages.

19 yrs to have a judgment . And these people are asking the taxpayer to double their salaries. What a cheek!!!!!!!!!!!

Still it is not a record. I had a very simple case that took 35 years to be concluded.

And then this Summer we had people complaining, in a very popular case that gripped the nation's attention, that justice was denied because the verdict was delivered eight years after the case started !!

After 19 years with 8% disability. I am not disputing how the court judges disability but 19 years!!!! I bet the company lawyers had a lot to do with delay.

A real shame; 19 years to await a verdict; and then they ask for improved salaries. They must be joking. Put your house in order first and then present your case.

If you have never experienced a Court Case yourself you cannot blame the Bench for the delay. A case may have to go through quite a few number of hands If one drops dead, that particular item might have to be examined right from the start. Besides a judge could be changed for a number of reasons. It all takes time.
It took about twenty four years to resolve positively our case, over three separate trials. In the end the delay worked perfectly.

what about if the company went into liquidation in the process, who shall pay the victim the compensation awarded by the court?
