Q: A few weeks ago, I ordered a sofa from a local retailer. The sofa, which was delivered a few days ago, was not the model I had ordered. I immediately told the deliverymen there must have been a mistake and that they should take the wrong sofa back.
After checking their documents, they said they carried out the delivery according to the company’s instructions. They advised me to contact the company and sort it out with whoever was responsible. What are my consumer rights this situation?
A: When buying such goods, it is in our interest to ensure that all the details of the sale are put down in writing. Your contract of sale should contain a clear and detailed description of the type of sofa ordered.
This should be proof enough of the mistake made by the company which should ensure that the wrong sofa is removed from your house and the correct one delivered at no extra cost.
If you do not have anything in writing that proves which model you ordered, try to speak to whoever sold you the sofa.
They might remember your order and therefore rectify the situation without any further hassle.
If, after speaking to the company, your problem remains unresolved, you may then file a complaint with the Office for Consumer Affairs so that mediation with the company is carried out on your behalf.
