A14-year-old Ecuadorian who lives in Spain was this afternoon jailed for two years, suspended for four, after he pleaded guilty to raping an 11-year-old Swede at a hotel in St Paul's Bay.
The boy, who leaves Malta tomorrow, was here on a school trip while the girl was on holiday with her family.
Both were staying at the same hotel.
Defence lawyer Stefano Filletti told the court that the two got to know each other and had consensual sex.
However, the girl told her father who reported the incident to the police.
Dr Filletti explained that according to law, a person under 12 could not give consent so the police were forced to charge the boy with rape.
