A fuel company has filed a judicial protest over the failure by the Office of Fair Competition to publish the findings of its investigation into Enemalta’s actions regarding the supply of aviation fuel at the airport.
Attard Services Ltd said it had complained to the office four years ago after Enemalta Corporation refused to grant access and provide facilities to the company to start operating as a fuel provider at the airport.
Even though the investigation by the office had been concluded and a judgment written around two years ago, the judgment was never published, the company claimed.
This, it alleged, had brought about serious doubts regarding the way the office operated because it led to the belief that it was delaying the publication due to pressure from a third party because of the change the judgment would bring with it.
Furthermore, according to EU law, each member state needed to have at least two companies to provide fuel, however, this delay had kept the country in breach of this regulation.
The office was causing losses to the company because it was not being allowed to operate pending its decision.
