A motorcycle pillion rider has won €36,500 in compensation following an injury she sustained in a 2006 collision with a car in Rabat.

The victim is Janica Marie Leaney who, the court, established was left with a nine per cent disability after the accident.

The bike she was on was being driven by Leigh Bishop, who tried to overtake a car driven by Ryan Abdilla in Valletta Road. At the time, Mr Abdilla was trying to make a right turn towards Ta’ Qali and the two collided.

Mr Justice Joseph Azzopardi noted that when Mr Abdilla testified, he said he did not see the motorcycle approaching.

However, Mr Bishop was also responsible for the accident because he should have realised that his manoeuvre was dangerous.

Mr Justice Azzopardi found Mr Abdilla two-thirds responsible for the accident while Mr Bishop bore the rest. The €36,500 compensation is to be shared in that proportion.
