I would like to join the chorus of letters that are appearing in your newspaper concerning misconduct by wardens. I too am victim of such malpractice.
Unfortunately, this is not the first time my car has been the target of unjust fines which I have contested and won either before the tribunal or after petitioning the respective boards. Yet it is so time-consuming to defend oneself from such abuse.
For this reason, I have decided to make this case public so that the authorities concerned may take action against wardens who are breaking prescribed codes and work ethics.
On August 14, a warden fined me for a parking contravention. I shall refrain from going into detail but I would appreciate the local council explaining to me the following:
1. How can a warden working for the Tarxien council penalise a car owner whose car is parked in the historic quarter of Paola (where the Hypogeum is situated) and in an area which falls under the jurisdiction of the Paola council and not that of Tarxien?
2. Whether it is a criminal offence for a warden to give a false name of a street to justify a fine?
My car was parked at the end of Triq il-Midfna, corner with Triq it-Tarzna. The entire area falls under Paola, including that part of Triq it-Tarzna next to which my car was parked, and I would like to stress that my car was not in Triq it-Tarzna.
My hunch is that this warden had to cite Triq it-Tarzna because Triq il-Midfna can never appear on his system since no part of this street falls under the remit of the Tarxien council.
Despite the fact that my car was parked 200 metres away from that part of Triq it-Tarzna which falls under the jurisdiction of the Tarxien council, the warden chose the remote connection that Triq it-Tarzna has with Tarxien to justify issuing his illegal fine.
I would also appreciate someone enlightening me as to whether illiterate wardens are being employed. At least, in this case, it is not only a question that the warden concerned did not know his boundaries but he was even unable to sign the document since his signature is missing.
This is the second time a local warden from Tarxien infringed village boundaries and targeted my car when it was parked at Paola.
It would seem the residents of Paola are now being subjected to maintaining the coffers of their neighbouring council.
I just hope this is not being done in collusion with the Paola council.
