Girl’s legal guardian accused of defilement
A 38-year-old man from Valletta was yesterday charged with defiling a girl when still five right up to the age of seven.
The man, who cannot be named to protect the girl’s identity, was allegedly her legal guardian at the time of the incidents between 2003 and 2005.
During the arraignment, held behind closed doors, the man was charged with defiling the girl while a legal guardian, holding her against her will and threatening her.
Magistrate Edwina Grima remanded him in custody.
Police Inspector Graziella Muscat prosecuted.

Making sexual advances towards a 5 year old is abhorent and wrong because the 5 year old cannot be expected to understand what is happening and can in no way protect herself. If the allegations are true then this is a real case of defilement.
However what about the multitude of cases where people (usually men) are accused of 'defiling' a teenager. Mnay of the cases feature 16 and 17 year olds. These are clearly not cases of defilement but are treated as such because our legal age of consent is 18 - the highest in Europe.
Both Jose Herrera (PL) and Franco Debono (PN) have spoken out, even in TOM, against this asinine law and have proposed lowering the age of consent. When is this going to happen so that decent people stop being labeled paedophiles and at the same time court and police resources can be freed up to find the real paedophiles as described in the article above?

Let's wait for the verdict to come out, but if he is guilty, this man's name should be named and shamed publicly. Don't mention the girls name, but people have the right to know who this creep is so they can keep their children away from him. I think the name and shame policy is a good idea and maybe it will deter other pedophiles from harming other children. We need to protect our children at all cost. Bleeding hearts, what would you do if this was your daughter? We are still waiting for the names of the priests that molested at least 8 kids at the orphanage. Why are we protecting the names? We know the names of the abused kids, why not the names of the abusers? Priests or not they are pedophiles and are or should be subject to the same rules. Cannot hurt the kids anymore but these 8 kids need closure.

I bet you would take responsibility if a crime follows as a result. I seriously see the need for more protection for our children but you must account for the fact that justice is there in place to prevent crime not to provoke it and unfortunately there is so much one can do until the line is crossed. Potential offenders are everywhere and the most dangerous ones are those who were never found guilty of an offence as yet. Those convicted should be monitored but studied have clearly show they rarely re-offend once caught. There are many other ways to protect our children but none is unfortunately clear cut. If you think children are protecting simply by publishing names then you are seriously deluded because it simply had any effect. Think rehabilitation instead of burning at the stake.
