Foreigners on long-term residence permit to follow course about Malta
People from outside the EU who apply for long-term resident tatus in Malta have to follow a course on the social, economic, cultural and democratic history and environment of Malta in order to help them integrate in Maltese society, according to a legal notice published in the Government Gazette.
The requirement is in keeping with directives of the European Union. It also applies to migrants who are granted a long term residence permit in Malta, such as those granted refugee status.
The course must be of at least 100 hours and must be provided by an agency recognised by the government. The applicant must attain a pass mark of at least 75%.
The regulations provide, among other things, that applicants have to prove that they and their families have stable and regular resources to maintain themselves without recourse to social assistance and that they have appropriate accommodation.
The regulations also provide that the family members of a person granted long term residence status shall be allowed to accompany the third country national in Malta.

most of the building regulations make sense: they should apply to all buildings, whether occupied by maltese or foreigners, as they are intended to avoid overcrowding and unsanitary conditions.
however:
i) from the age of six onwards, only children of the same sex can share a bedroom: i don't see why, it should be left to the parents to decide this.
ii) Every bedroom should be located so that it is not necessary to pass through another bedroom in order to reach a bathroom, toilet, or an area such as a hallway: most traditional maltese townhouses were, in fact, built in this manner!

ou must have quoted from MEPA policy guidelines, not from regulations enacted according to the EU Directive (2003/109) !!!!!! Is it not farsical and baffling common sense ? Do long term foreign residents build their own accomodation in Malta ? Do they build without proper MEPA permits ? Until the Expatriates Directorate examines the building, the resident would have moved house ! Is the Expatriates Division engaging architects to measure sizes of windows ?
Are they going to be the long arm of MEPA ? Then at Mater Dei you have offices without any windows ! And at the Family Court mediation cubicles without windows.
I would suggest an amendment to the regulations. It insists on a bed, wardrobe and chest of drawers. It should mention the size of the bed. Only double bed should be allowed. And what about the size of the wardrobe ? And how many drawers in a chest of drawers ?

Why so much agressiveness against me for quoting the law? I did not even express my personal opinion regarding the requirenment for accommodation of foreigners, the only I said was that I wish Maltese people will have such conditions to live.

Ventilation
(j) Every bedroom, living room and kitchen must have

(ThIRD COUNTRy NATIONALS)
REGULATIONS,
2010
WITH reference to regulation 5(2)(b) of the status of
Long-term Residents (Third country Nationals) Regulations,
2010 the standards for the appropriate accommodation
referred to therein shall be the following:
Structure and repairs
(a) The property must be structurally stable and free
from serious disrepair. It must have adequate provision for
lighting, heating and ventilation and an adequate piped supply
of water.
Bedrooms
(b) The property must have one bedroom per adult
couple. children of both sexes may share a bedroom until age
five. from the age of six onwards, only children of the same
sex can share a bedroom.
(c) single bedrooms must be at least 6.5 square metres,
and double bedrooms must be at least 10.5 square metres. An
additional 4.5 square metres per person, applies in the case of
three or more persons sharing a bedroom.

I hope to be talking here about people contributing to Malta's economy, having their rights reduced in capacity to bring their kids to live with them, to bring their spauses and pay their tax as a married persons. Also let's not fail to mention 100 hours of lessons to be paid by person applying to ETC and 75% score controlling criteria, which leads a working men into even more uncertanty than they already have about their Malta perspectives.
To those of you who would make another xenofobic imigrant looking issue out of this, the Long Term Residents (LN278of2006) are not people who are in Malta for the following reasons :
(a) in order to pursue studies or vocational training
(b) on the basis of temporary protection or Temporary Protection for Displaced Persons
(c) on the basis of a subsidiary form of protection in accordance with international obligations(d) as refugees or who have applied for recognition as refugees
(e) solely on temporary grounds such as au pair or seasonal workers, or as workers posted by a service provider for the purposes of cross-border provisions
(f) who are enjoying legal status governed by international conventions on diplomatic and consular relations.

You are 100% right. The spirit behind those regulations should be the pre-amble to Directive 2003/109/EC. I pity your situation, if you had to go through the same frustrating treatment meted out to persons whose cases I know. I have written to the EU Commission about a case and they have replied.
Now if your country of origin, which seems European from the surname, becomes a member of the EU, you and your family, without changing anything will be in a completely different position ! And if someone from Africa gets Dutch citizenship, then he too will not be harassed. So much for human beings and what they are worth.

They should also:
1. All non Catholics must change the religion
2. All that are granted long term residence permit must keep their mouth shut and absolutly may not interfere nor comment on our business
3. They will acknowledge in wrighten that beside higher tax deducted from their salary they will also make generous donations to Maltese society and/or charity
4. All other earning they must spend in Malta thus they wouldnt be allowed to have savings... naturally
5. They will rent apartments at higher cost... of course and pay higher electricity bills... in matter fact they should pay the bill of their maltese neighbours as well
6. In no case they will get involved with Maltese woman
7. The only beach they would be allowed to use is below Maghtab
8. They must be involved in voluntary work in reparing potholes on our roads
9. They should do the shopping for their Maltese neighbours... do their garbage too of course
10. Every time they come across Maltese on the street they should move aside giving them the road

This is just yet another law which only applies to law abiding people. Criminals will be exempted.
A case in point is that of the Algerian illegal immigrant who has just been awarded €12,000 by the ECHR from our tax money because he was kept in detention pending deportation. But he refused to cooperate with the immigration authorities and this rendered his deportation impossible. Hence his detention was deemed to have been in vain and therefore illegal. Mind boggling, I know.
To get by nowadays, one has to be criminal and socially irresponsible. The EU with its daft directives and bureaucracy is getting tangled up in its own red tape and dragging honest, working and tax-paying citizens down with it.

When I say that we are specialising in go round EU regulations, this is serious. Many would consider that qualifications in one country would be accepted in another, but not in Malta. The European Court of Justice (this is not the ECHR in Strasbourg) held that an Argentinian dentist who had a European nationality could not be debarred from exercising his profession in Spain. (Micheletti case)
Would you believe that the Maltese State, flouting EU law and interpretation, refuses a Maltese citizen the right to exercise a profession fully recognised in another EU country ?
Possibly that legal notice may be amended so that foreigners would have to learn EU regulations. Concurrently the course will be held for public officials. I would suggest a pass mark of 75% for foreigners and 50% for officials.

I would invite readers to search the web for "EU policy on immigration" and "EU action plan on immigration". You will be surprised that one of the glorious achievements is a coordinated website to exchange information. On Dec 24 2010 a new directive will come in force. The individual countries shall send back those coming in illegally. It is one thing for the countries to the North, but a totally different situation for the countries bordering on the Mediterranean. It is one thing for Italy which has a navy and another thing for Malta which has patrol boats (?)
I am afraid that desk and armchair strategies do not solve problems.
What is worse are contradictory policies. The EU is considering seasonal employment for Africans. Work in agriculture, other difficult tasks etc would entitle importing labour from Africa. I have a suspicion that this would mean "traders" of people in Africa who arrange for such seasonal work. There is a pattern in history. Only the Masai tribe (living partly in Kenya and partly in Tanzania) resisted slavery.

Why should this only apply for non EU citizens? Is it not equally important that people with a long term resident status from within the EU familiarize themselves with the Maltese culture? This not the least, when there at the moment is a heavy "immigration" (or a large number of long term residents) from North European countries, who in general seem to have a relatively poor knowledge of Maltese history, culture and language. In fact, it might not be completely unjustified to state, that world citizens from outside the European Union boundaries, in general seem to master for instance the Maltese language much better than long term residents from the EU, which would imply that there within these groups/communities might lie a greater interest of integration- hence, this law should apply for all citizens of the world, who desire to uphold a long term resident status on the Maltese Islands.

This is a really good joke. Those who are terrified of foreigners should reflect that this is how to thwart EU regulations. Long term residents may be people who are doing restoration works in Valletta, collecting the garbage, even pensioners who bring their foreign pension here, whether American, Canadian, Australian or Libyan. These are not boat people, as first the immigrant has to be legally on the Island.
The pass mark. Are they sitting for a university degree ?
Who is going to lecture on such subjects ? What is the curriculum ? On what texts are they going to study ? And in which language ? "Economic History of Malta" does not even figure on wikipedia. Pardon my lack of information, but who really researched and published about the economic history of Malta ?
The Expatriates Division has been, for one reason or another, refusing even applications which they are bound to supply, according to EU Directive 2003/109/EC. Once I could not believe the story, and I accompanied a person to Castille. I had the scene before my own.eyes.

There are many laws and regulations that have to be adhered to when issuing long-term residence permits to those from outside the EU. However not all are being enforced and many are being flouted.
Some have been here for over a decade and yet, year in year out, their permit is regularly issued on the flimsy pretence that no eligible Maltese is available for the job. This is a farce to say the least as the permit issued is for normal daily callings which many of the Maltese registering for work can take up.
Illegal work, the majority on part time pretext, by such non EU and their acompanying families, without paying any National Insurance, tax or vat, is rampant in any job immaginable. All this malpractice is at the expense of the hard woking Maltese citizens who are struggling hard to make both ends meet.
Parliamentarians and those in authority please note and take immediate action to stop this malaise once and for all.

This is not enough !
People from outside the EU who apply for long-term resident status in Malta must:
1. have permament employment or stable income
2. pay a higher rate of taxation (55% minimum) since they are making use of our scarce resources most notably land and water
3. their permit must be reviewed every six months
4. submit a police record sheet
5. permit be terminated in case of any prosecution
6. must prove that they are net contributors to our political, economic and social infrastructure
If we open the doors to everyone, we end up with more houses, cars, electrciity shortages, water crises, criminality and social explosions

I endorse that in its enterity right to the point and i would even go as far as charging long term foreigners including from nothern europe members of the eec or not a higher rate of tax and even capital gain tax on properties sold here and money transfered to another country. Not fprgetting those who come over here from the UK driving months on end with a foreign number plate, its not fare that we Maltese should pay when these foreigners getting away with it scot free/TV licence included.

This article should have been titled " families of immigrants grantd residence permit to be allowed to move to Malta" . This is a very worrying move as we currently have close to 10,000 immigrants most of whom are male, this now means they can bring over their wives and dependents and we can very shortly be inundated with persons who will be bringing very little material wealth (most probably) and could possible eventally be welfare dependents as well as bringing very little of the skillsets we need in our eonomy. has this move been forced upon us by EU regulations? Why has no debate taken place on this issue? Where will these people be living ? Who will pay for them? I for one do not wish or want to be responsible for these people's welfare but it appears that the 2 main parties here do not really care about our country.......... Time will show us and I hope I am mistaken and we are not going to end up with a new generation of beggars and vagrants all over this island......

Hasn't this practice of getting one foot in and then the whole family somehow follows through the same ILLEGAL channels become a standard practice by now?
This course is standard procedure in Northern European countries.
I think that people attending the course MUST be charged the relevant full expenses regardless of status, and NO subsidies (from the Maltese taxpayers', EU, or otherwise) should apply.
The lesson Malta MUST learn from Sweden and other Scandinavian countries is that it is UNSUSTAINABLE that EU nationals (like myself in Sweden) have to pay some 500 euros a month for this part-time course, whereas the illegal economic immigrants are paid some 50 euros (per person) in social benefits to attend (and no fees apply for them). Here it is crazy. I hope it won't be the case in Malta, as any faint possibility of ever reining in the deficit would be surely lost.

Yes indeed Philip. One needs to keep in mind that Malta has the highest percentage (55 per cent ) of refugee status acceptance rates in the EU. I was never under any doubt what was in store for us or that the invasion of Malta was not EU engineered.
