A married woman had sex with a stranger to get pregnant, a judge ruled yesterday, proving the husband right when he insisted he was not the biological father of a girl born to his wife.
The man insisted the girl born in 1998 was not his but the result of an extramarital affair his wife had had.
The wife claimed her husband had misled her and failed to tell her he was infertile before the marriage.
Medical experts testified it would have been very difficult, though not impossible, for the husband to have fathered a child.
Mr Justice Noel Cuschieri, sitting in the Family Court, said he could not conclude that the husband had misled his wife about his fertility. However, the court was able to establish that the wife had had a 10-minute sex encounter with another man purely in order to get pregnant.
The court noted that another child born to the woman in question in 2008 was also not the husband's biological child.
In conclusion, the court found in favour of the husband and ordered that his details be removed from the girl's birth certificate.
