Labour MEP Edward Scicluna said today that he considered a Broadcasting Authority decision to fine Smash TV for a programme in which he was the sole guest as being a mistaken interpretation of the law. He said that the decision could also be seen as being in contempt of the European Parliament.

The BA last month fined Smash TV €1,164 after is said that rules on political impartiality were broken in three programmes which discussed matters of political controversy and in which only Prof Scicluna spoke.

Prof Scicluna said that the rules laid down that political balance had to be viewed within the station in general and not in particular programmes.

He said he would raise the issue in a question at the next plenary session of the European Parliament in Strasbourg since the BA decision left him with no choice other than to stop the programme or not to discuss local issues.
