I refer to a letter The Nadur Cemetery (February 18). Mepa will not go into the merits of this case given that the application is sub judice.
The Authority would like to point out that with the new legislation proposed in the Mepa reform, when there is a case of a development which falls either outside the designated area for development (ODZ) or in a scheduled property, the Environment and Planning Review Tribunal, which will replace the existent Planning Appeals Board, will be able to suspend the implementation of the development permit, in whole or in part, subject to the outcome of the appeal.
This measure will enhance the safeguards of the citizens' rights and improve the protection of land use.
