Accused of being drunk and defiling two children
An illegal immigrant yesterday denied exposing himself to two young children while drunk in Birżebbuġa on Saturday evening.
Osman Hussein Du Ale was charged with defiling a 10-year-old boy and his 12-year-old sister, corrupting them, offending public morals and being so drunk he was unable to look after himself.
Legal aid lawyer Martin Fenech said the alleged crime was not as serious as the charges made it out to be and his client never touched the children. Furthermore, one ought to bear in mind that the man was drunk at the time and he flatly denied exposing himself to the children, Dr Fenech insisted.
He said that if the court granted bail there was no fear of tampering with evidence because the accused did not know the children or their mother.
Magistrate Claire Stafrace Zammit said that at this early stage of the proceedings she would remand the accused in custody until the first witnesses were heard.
Police Inspectors Melvyn Camilleri and Carlos Cordina prosecuted.

nobody is saying any immigrant should be granted any advantage over maltese citizens: the law is the same for everyone, including immigrants. they do not have the same rights as a maltese citizen, but they do have legal rights which are to be respected.

One of the reasons that there are long waiting lists in court is that many people, like this man, are ending up in court when they shouldn't. The police have the power to arrest anyone and put them for 48 hours in a little dark cell. If they wanted to punish him that would have been enough. No waiting lists, no expense (bar a few sandwiches and mugs of coffee).
The police could have done this if no formal complaint was lodged by some hysterical parent.

These do good apologists will soon be defending the action of the next Somali who fires a firearm on the streets of Malta, as that will be explained away by them as" their cultural right" because it is what they do in Mogadishu !!
Ignorance of the law is never an excuse anywhere in the world.
Try doing what this Somali did in Germany or Japan or Switzerland or Saudi Arabia even.
I am sure their local police would have given him a pass jail card because of cultural sensitivities.
Give us a break Dr Gonzi and start to repatriate these people to where they came from, enough is enough.

I have to strongly disagree with you, If we accept this man's wrong behavior on cultural grounds, then the next Somali illegal who decides to molest a woman because she is not covered up like they are in Somalia for example, then it is a free for all.
You cannot have several sets of laws in Malta , one for the native and several depending on the culture you are dealing with when dealing with illegal immigrants.
The fact that they are in Malta illegally shows that these people are not strangers at breaking the laws of the land. Being soft on these people is the largest mistake any legal system can make.

THere are two extremes. Pardoning a person because he comes from a different culture is one of them. Assuming that he must be some sex maniac from reading a little article on the ToM is another. REst assured that if he happened to be Maltese, people here would be up in arms asking whether he was just having a pee on the wall, and if yes why is he still in custody.

I appreciate the fact that nobody here is calling him a paedophile or a sex offender. We may not agree whether he should be in Malta or not or on countless other things. But calling him a child defiler is WRONG. So at least you guys have enough sense to see that the parents and the police are throwing all the laws in the book at this poor soul for nothing. Even the kids who might have seen a black man pee are going to suffer because of the police/parents over reaction.

T Gauci. You don't need odles of money to get drunk especially if u are not used to drink. Last time I checked a bottle of the cheapest maleste wine cost about ONE euro. That is enough to knock a non drinker out flat. Please stop dreaming of conspiracy theories.
These are unhappy people who happen to be black. Like you and I who are a lighter shade of black they are often unhappy. Like some of us they try alcohol to forget the miserable lives that they are leading.
Why don't we try and stop them from resorting to alcohol by giving real help perhaps?

WOW - you really are giving your illegals the high life aren't you? Enough money to buy alcohol and get drunk? Are you serious? He should not even be in Malta let alone wandering at will, living like a parasite off us all (I say us cos EU funds are being used for these peoples), your island whilst beautiful is becoming a place that tourists are shying away from - there are of course several reasons, the high costs of everything, but the illegals roaming the streets in groups and pairs and loitering all round the place....

Not all cultures are created equal, why do you excuse the criminal actions of these people, they are not children. For what this man did in any civilized nation, when apprehended he would have had the full weight of the law fall on his head, no ifs or buts.

Do you think people in Somalia wait in line in a queue to go to the ladies and the gent's after devouring some 'happy meal'? This man was drunk as some or many of us have been at some point in our life. He urinated in public which is wrong in our culture but it is one of the mildest and most harmless things that people do when they are drunk.
I suspect that the 'shocked parents' would not have been so perturbed had it been a drunken blond sailor doing the same thing.
Somalis are not used to alcohol - they barely get enough to eat let alone to buy alcohol so a couple of beers could have rendered this man senseless. Accuse him of being drunk, disorderly and unhygienic but don't make a child molester out of this poor man please!
The other day I complimented a Somali on his white teeth and I asked him about dental care in Somalia. I asked him whether he was afraid of dentists. What dentists? he asked me. They pull out your teeth in the street with no anesthetic in my country!

In the 'malta-exposed' blog there is a story where a man was accused of defiling a kid because the man stopped his car in the middle of nowhere to have a leak. A car happened to be passing by and a kid saw the man urinating. Shock! Horror! The poor man is now in the sex offenders register.Bring it on Dr. Carm - it will soon be bursting at the seams and your constituents (those not in it) will be happy.
Raise their hands those men who have NEVER in their lives relieved themselves amongst some bushes or against a wall! It's one of the first things my father taught me to do! But now it is called defilement.

Another case of the mass hysteria gripping the nation as when it comes to child abuse. For heaven's sake the man was inebriated and decided to relieve himself against some lamp post and two kids saw him. It is NOT traumatic for a child of whatever age to see a man or a woman urinating! What is traumatic is the hulabaloo that the police and their parents are creating. The children will also have to testify in court.
If you really loved the children leave them out of it and change the charges. He can be charged for being drunk and for urinating in public. Not because of any immorality but because it is dirty and unhygienic just like spitting or smoking are!
Remember guys - next time it could happen to you.

That's OK then, he couldn't have been responsible for his actions. Whatever next? He was force fed alcohol so he was not even responsible for getting hoplessly drunk in the first place?
Birzebbugia is no longer the safe, relaxed seaside resort it was up until a few years ago. However, the residents do not seem to mind the "cosmopolitan" atmosphere.

Illegal immigrants come in illegally, they stay illegally, they commit more offences on average than us Maltese, they cost us to maintain, they cost us in legal aid. In the meantime the Maltese , including judges, complain of long waiting lists of cases in court.
