Allegations against magistrate noted by Commission for Administration of Justice
The Commission for the Administration of Justice has taken cognisance of the allegations made against Magistrate Consuelo Scerri Herrera and the police are investigating the situation, Home Affairs Minister Carmelo Mifsud Bonnici said this morning.
In a series of blog entries, columnist Daphne Caruana Galizia has criticised the magistrate, arguing that her behaviour was inappropriate for someone in her position.
The magistrate has since abstained from presiding over two unrelated libel hearings involving Ms Caruana Galizia, who said she was "petitioning the Chief Justice" to get the magistrate off the cases.

@ Mark Bishop. The position you hold yes determines the way one should live as it may compromise your position at work.
EX Comm of Police Grech had to resign when his private dealing were exposed by the media. John Terry has been stripped of the English team captaincy after revelation of his having an affair with the former partner of English teammate Wagne Bridge. I suggest to Mark that he go over the the website where this case is being exposed and then judge for himself whether a Judge is right to associate so freely. Courts officials should take care of their integrity if they want the people to have trust in them.

@Peter Vella: do not rush to conclusions. Remember all that you read on the blog was one perspn's interpretation of the facts. There could have been much twisting and innuendo. Also' keep in mind that the attack did not start as a defence of Malta's judicial institiutions but as one woman's revenge on another for passing comments on the former's private life

@ Mark Bishop. Precisely because one is a Magistrate. Or rather, his or her private life should be seen to be exemplary since a Magistrate and more so a Judge, is empowered to judge people's actions. What happens behind closed doors is one thing. But when certain behaviour is blatantly exposed and bragged about BY ONESELF it risks debasing the institution one represents.

Perhaps Daphne and chums should check The Times again.

Surely there should be a process where cases are assigned only to those magistrates who are not related to, nor have an interest in the case/accused or their families in any way?
However in Malta its probably just a case of 'who wants to handle this case?'

David Stephen Ganado: You are wrong: only one of the photos was from the magistrates own facebook page. All the rest were from the pages of 'friends'. So be careful next time you are photographed by anyone as you don't know where the photos will end up and how someone with evil intentions might use them.

Mr Ganado how can you say no Paparazzi are involved if the photos were copied and uploaded on a website of a journalist entailing details of what ensued at the Magistrate's personal social events? Facebook has clear privacy and copyright rules.
If any laws were being breached, this was to be reported to police. Otherwise in my opinion, it is just harassment. We need to start living in 2010 and the reality of virtual life environments and the right to a private life.
I probably also have electronic images on the web from my profession, but I certainly don't want them to end up on some journalist's blog and made fun of! I don't know if you tend to digress on this...!

I fail to understand one fundamental thing in all this ado: why isn't a Magistrate entitled to a private life?

This will be a real test of how effective the Commission is in tackling wayward behaviour. Many have already formed an opinion on this case based on all that has been made publicly avaialble. We will be waiting for the result with great interest.

@C Sammut, you got it all wrong.

@C.Sammut - You obviously have not realised that all the photos shown were to be found on the Magistrate's OWN Facebook page, so no Paparazzi were involved.

Where is Reno Bugeja? A program in this regard with footage of private events of major public figures (especially in the judiciary), should be aired! Paparazzi need to show respect for everyone's private life and set reasonable boundaries.
