Claim for damages for horse's death turned down

The Civil Court has turned down claims by the owner of a stable in Marsa that works on the Maltapost office in 2004 demolished the stable and injured his horse, leading to its death a few months later.

Emanuel Caruana, owner of Twilight Stable, sued C&F Building Contractors, Schembri and Sons Ltd and Maltapost demanding payment of damages for the death of the horse.

He said that his race-winning horse Darim was injured when debris fell on the stable, demolishing it, on September 15, 2004. The horse died in January.

The incident was not contested, but the parties denied that the horse died as a result of what had happened on that day.

Veterinary experts told the court that there was no link between the injury suffered by the horse in the incident and its death.

Neither had it been proved that the horse failed to win any races after September 2004 because of the injury it had suffered. Indeed, the horse had a previous injury in the same place and it was its age which brought its racing to an end.
