Trusts, and how they are treated in court cases in Malta, will be the focus of a seminar on February 4, organised by the Institute of Financial Services Professionals with Society of Trust and Estate Practitioners.

Max Ganado, Andrew Chetcuti Ganado and Annalise Micallef will discuss the way Malta's trust regulations have been interpreted by the courts, taking as their starting point actual cases documented in Maltese Cases and Materials on Trusts & Related Topics, Vol. 2, published recently by the IFSP. The seminar should provide participants with a good understanding of principles such as the role and responsibilities of the trustee, and how the courts have contributed to the development of trust structures, among other issues.

The new volume, the result of a collaboration between experienced professionals and law students, is not a textbook following the genesis of trusts or their theoretical operation. Rather, it discusses the operation of trusts and other fiduciary institutes in context, from a jurisprudential perspective, while examining the development of the area since 2004.

In this, it is a welcome extension to the first volume, published soon after amendments to the Trusts and Trustees Act and the Civil Code were put into effect in 2004. The first volume went a long way to ensure that practitioners in the area had access to materials relevant to the new laws; Volume 2 builds on this, adding the results of close to five years of experience implementing them.

The seminar will be held on 4.30 p.m. at the MFSA conference room in Mrieħel.

There is no fee for participation, but one must register since seats are limited. Copies of Maltese Cases and Materials on Trusts & Related Topics, Vol. 1 & 2 are available at a special price of €15 for students and members of the IFSP and STEP, and €25 for non-members.
