Data Protection Commissioner dismisses case against PN General Secretary
The Data Protection Commissioner had dismissed a case filed against PN General Secretary Paul Borg Olivier by PL leader Joseph Muscat over the handling of complaints made to government officials.
Dr Muscat had claimed violation of Data Protection in an e-mail by Dr Borg Olivier on customer care which could be given to people complaining to government officials.
The PN in a statement said the Data Protection Commissioner had concluded that there had been no processing of personal data and therefore the data protection law was not broken.
The PN said this decision proved the falsity of months of mudslinging by Dr Muscat against Dr Borg Olivier and officials of the Office of the Prime Minister.
Dr Muscat had filed his case with the Data Protection Office on December 4 last year.
He had said that Dr Borg Olivier had written to ministries asking them to forward details on the persons submitting requests and complaints to the government. The e-mail was also mistakenly sent to then PL General Secretary Jason Micallef.

We need to see the full text of the Commissioners report to comment on this.
Maybe no breach took place - but only because of Borg Olivier's error.
What would have happened if the matter had not come to light?

The commissioner further stated that: “For these reasons, the General Secretary of the Nationalist Party is being warned that his request, had it been implemented, would have had serious consequences on the right to privacy of the individuals about whom personal information would have been issued.”
GUILTY. PBO GUILTY.

Another 'zelqa fin-niexef' by Joseph.
In his first year or so of his LP leadership, Joseph must be coming close to the miscues, misinformation and miscalculations of his predecessor's sixteen year record as the MLP chief!

Even though the case was dismissed,there's nothing to crow about,Mr. Demartino and fellow PN apologists. You are simply trying to console each other because the maduma party is falling apart. The people have long lost confidence in govt. entities. The excuse was that the data gathered had not been yet processed. But was there intent to process?

Is it possible that no authority ever finds anything wrong with "our " government? In the EU and in the USA inquiries are held in the open and people and witnesses talk. Take the Iraq war, the investigation is held publicly. Is Malta fast becoming a "non-transparent" country?

I am more than convinced that Joseph Muscat, like Joe Citizen may NOT be satisfied with the explanation.
GiovDeMartino certainly is , as he can just continue to go over to his Party Headquarters with his requests , grievances or complaints. He has no trouble at all and is not worried at all about being vetted by his Party’s customercare officials, unlike the man in the street, amongst which are certainly members of this community that have never entered a political party club.

@ Giov De Martino - I am not one who waves a RED FLAG but that decision is RIDICULOUS!
If it was a Murder it would have been an ATTEMPTED murder and sentenced however not left as if nothing happened!
@R. Caruana - And you are happy that your beloved party is not a scandal? Of course the party isn't but the sentence is! If you think the PN is winning votes just because the case was dismissed you're wrong! It's disgusting!!!

Dear PN supporters, please read the sentence well:

This means that thanks to this case being made public, the PN was stoped before breaking the law!
The PN's statement in this regard will only fool the ignorant.

Where does Joe Citizen stand Now?
Mr. Citizen goes to P.N. Party Headquarters with his complaints or requests were he is "vetted" by the Party Official before his complaint or request is handled ?
Malta is fast becoming Disneyland in the Mediterranean with these Mickey Mouse Antics and rulings.

This case should be taken to a European Court. As a citizen I have a right, to not have details of my communication with a government entity, divulged to third parties unless with my express consent.
