Mepa audit officer mulls resignation

Falzon says his situation is intolerable

The planning authority's audit officer, Joseph Falzon is considering stepping down because he "cannot continue working in such a hostile environment".

"I haven't yet decided whether I will be resigning but I'm thinking about it. All this (my work) is a waste of time," Mr Falzon said.

In less than a week, Mr Falzon's actions were harshly condemned and criticised from two fronts: by Prime Minister Lawrence Gonzi, who accused him of jumping to conclusions on Sunday, and, four days later, by the Malta Environment and Planning Authority.

Mepa lashed out at its own auditor over a report probing a development permit in Qala, saying he should never even have investigated or published the report because the matter was still before the appeals board. It said Mr Falzon's actions contradicted the Ombudsman decision, a higher institution.

A similar situation arose in 2008 when, on Mepa's request, the Ombudsman told Mr Falzon that publishing a report on the controversial recycling plant in Marsascala would prejudice the pending appeal. Mr Falzon had complied.

This time, Mr Falzon criticised a decision by one of Mepa's boards that allowed a hotel overlooking the picturesque Mġarr harbour to be converted into apartments, saying this permit should never have been granted.

Mepa's criticism was the last straw for Mr Falzon who said. "Whenever I criticise something, everyone goes on the defensive. If the authorities don't want an auditing process then why don't they scrap it, after all it's costing the country millions of euros?"

Regardless of Mepa's criticism, Mr Falzon still felt he did the right thing in looking into the case because of its environmental importance. "I decided to investigate the case because an appeal was filed by a third party. This meant the developer could go ahead with his works because he had all the permits in hand," he said.

If, and when, the board decided in the objectors' favour, it would have been too late because the development would have materialised, he added.

Mr Falzon criticised the workings of the appeals' board, which, he said, took an exaggeratedly long time to decide, sometimes years. The appeals' board was not a useful tool for third party objectors, he insisted.

He said there was nothing in Mepa's regulations preventing him from investigating a case under appeal.

Mepa's criticism and the Prime Minister's comments led Mr Falzon to describe his situation as "intolerable".

"The role of an auditor is there for a reason: to point out an organisation's shortcomings," he said.

Dr Gonzi described Mr Falzon's comments on a court ruling as "shameful" because he had not asked for explanations but just jumped to conclusions. However, when contacted earlier this week, Dr Gonzi said he would not be demanding Mr Falzon's resignation.

Mr Falzon's comments were on the controversial Mistra disco development case after a magistrate cleared two former members of the Developement Control Commission of exercising private interests in approving the outline permit for the open-air disco.

The magistrate concluded that meetings between planning board members and developers were common practice.

Mr Falzon deems such meetings "illegal"", even though he acknowledged the magistrate was making a statement of fact when she said such meetings had become common practice.

Meanwhile, Labour environment spokesman Roderick Galdes said the auditor's report confirmed the Qala development was not consistent with the area's policies.

Mr Galdes, who is also Labour's representative on the Mepa board, said the auditor should be allowed to continue checking the accountability and transparency of the planning process.

Similarly, the Ramblers Association said it was shocked by Mepa's rebuke and insisted an explanation was morally due.

Mr Joe Falzon is neither saint not firework. On the other hand MEPA has a dismal environmental track record. The developers definitely brandish eloquent vetos in the MEPA corridors. It is no consolation that we can acknowledge a number of conscientious professionals at MEPA that are arduously trying to clean out the Augean stables. We had hoped that the Prime Minister would himself provide the ultimate auditor and had certainly never expected him to stoop to undermining the Auditor's office himself. Many Maltese citizens who had become totally disillusioned by MEPA's complete disregard of the spirit of its own mission statement had come to consider the Auditor's office as their last resort. They, unlike the government's apologists, are determined to defend the little environment that remains, and they congratulate Mr Falzon n not for his heroism, but because they recognise in him an honest professional who considers his conscience and his reputation to be more valuable than any accolade that might be awarded him by the powers that be. We urge him to stay on. There is a majority of honest Maltese citizens backing him. And this majority is in no mood to remain silent.

I must admit I do not know him personally but I would bet my last cent that most of the people writing in this blog have also not had the pleasure of that lovely experience. I would also put my head under the guillotine that most of them are politically motivated or have some axe to grind.

However one only needs half a brain to reach my same conclusion after reading this article.

If the mepa auditor Mr. Joseph Falzon was to contest the local elections, surely he would be elected with flying colours. The reason being that the vast majority of us maltese and gozitans highly respect the most esteemed , fair person and the constructive advise that Mr. Falzon has always given and always identified what was wrong and suggested remedial action.
We are surprised and disagree (for the the first time) with the honourable Prime Minster's attitude against our sincier MEPA Auditor, the person who identifies wrong doings and mistakes which adversely effects our livelyhood and the environment for the profit of speculators.
We request the PrimeMinister to appoint a dozen of other staff to help the present auditor Mr. Falzon and not unjustly discredit his valuable work.
If this particular auditor resigns we are afraid that the Prime Minster will lose credibility regarding the correct operation of the MEPA for which he is responsable today.
It is obvious that without a fair auditor like Mr. Falzon the MEPA would not have a valid watchdog and their future actions will be a detriment to the PrimeMinister as defects will be hidden in the future.

OMG whatever shall we do - what if he actually resigns?! There will surely be mass suicides in this great nation full of conciencious people!

I am sick of hearing people to bring him down ; such a saintly person. He admits that he only goes against regulations and the ombudsman's rulings when his concience (so nice and clean) screams at him to ignore all in the name of justice! How can anyone find any fault in that?

HE CAN DO ANYTHING BECAUSE HE IS FAULTLESS - THE OTHERS ARE JUST MERE HUMAN BEINGS SUBJECT TO ERROR AND FAILURES.

Yeah i agree that environmental ngos are lacking in this regard.. Environmental elitism thinking is simply excluding civil society organisations and the common people.

Verdala Golf course campaign included various organisations from the grass level and was a success, without any help from the EU.

I think environmental ngos have to open again to the public as they are losing grounds from reality and support of the common people.

May be one day they will realise that, if not too late. Hope they not vote the same Government who is threatening democratisations of the institutions.

You are the only beacon of hope for us Maltese and our children. If it wasn't for you, the Ramblers, Astrid Vella, and the other NGO's, this country would be buried under more empty concrete blocks.
I can assure you that the majority of the level headed people in this country have more trust in you than any other politician. They have driven out your assistant, insisting that they cannot work with him. They have attacked Astrid Vella. They will carry on crucifying you until they see the back of you You must remember that Malta and the Maltese need you.

I exhort the Prime Minister - and Cabinet - to BEG Profs Falzon to stay. It's people like him who rise head and shoulders above the motley crowd of unethical, incompetent and (sometimes) grasping oafs that up to now have manipulated Mepa, ruined the environment..
Mepa Reform URGENTLY requires the strengthening of the Auditing Office. Had Dr. Gonzi assigned more funds for this purpose in the 2010 Budget he would have done Malta - and the environment - a much-needed good turn. His credibility would have soared. Sadly (at least where Mepa Reform is involved) the P.M. remains unconvincing. He would do anything to try to convince people that there is harmony - and correlation - amongst the numerous national institutions - Mepa, the Auditing branches, the Police, the Courts...We all know this is NOT the case! It's unacceptable that anybody should silence our Auditors; dictate that one institution should not criticise another - if such need is justified.

The honourable Ombudsman has nothing to preach or set an example, for he too commented and condemned the Santa Marija project knowing that there were two cases filed against the project together with an appeal in front of the Mepa Appeals Board. It was only in the case of the Sant’ Antnin Recycling Plant report that the Mepa Auditor was advised not to published it and to this present day it is not official. Shame on the Ombudsman, the Planning Authority and The Minister responsible then, for the environment. Both appeals, for the outline and the full permits are still pending since 2005 in front of the Appeals Board. Disgusting!! The Auditor, Mr. Falzon is no doubt an honest man but the people criticizing him and want to see his back are by far credible.

You talk (write) like some other government apologists who just cannot stand any person who has the moral fibre to criticise the workings of a government entity. In this particular case this happens to be an auditor who is just doing his job. I can assure you that Joseph Falzon is not seeking attention and has no interest at all in politics. He just happens to be a very strict, scrupulous and honest person who knows his job and does it well. It is only persons seeking either their own or their party's political agenda who want to see him resign. Their utterances are chorused by the usual apologists who also have an agenda to follow.

Stand firm, Mr. Falzon and do not play their game. Your actions being condemned by the Prime Minister’s Office and the usual chorus or xarabank of sustainers, is proof enough that Mr. Falzon is doing a good job fully appreciated by the man in the street who admire such altruistic qualities and dedication .

I took made a complaint and although a report was prepared and there were some disagreements with the permit, the ruling was not forceful enough so the developers got their way and the properly was suppose to be protected.

Please don not give up your fight. A prophet is seldom revered in his own country but if Malta wants to stay Maltese and have any chance to survive as a unique tourist destination in a slightly longer term you are Malta's only hope. Without you as the only safeguard to Malta's unique heritage, landscape etc., etc., this country will become as non-descriptive and boring as many other places in the Mediterranean that have been sacrificed to a lucky few that made a quick buck and the very mixed "blessings" of mass-tourism.

The ombudsman's ruling referred to the Sant'Antnin waste plant; there was no indication that it was a general ruling. Even more to the point, the auditor now forms part of the ombudsman's office. How come the ombudsman has said nothing in this case?
I mentioned no conspiracy only concert. The situation does not need active conspiracy, if the atmosphere is suitably poisoned. All it needed to eliminate Beckett was for the king to exclaim "Will no one rid me of this turbulent priest?" That was enough for four bullies to come out of the woodwork and do the deed.

For the record, months ago i asked the MEPA auditor to investigate two villas in Baħrija (sending him all the necessary details) but all I received was a routine acknowledgement. Does Mr Falzon pick and choose the cases he investigates and, if he does, what are his criteria?

The public needs impartial objective analysis. Publishing press release after press release from the political parties, MEPA, giving ample space to vested interests to impress us with their 'inside knowledge' (carefully fully filtered before they choose to dispense it of course) is not enough.................. while the few people in the country who are actually going against the grain and doing their job even if this involves criticising vested interests for a normal wage have only the hope that their own 'press release' gets read and understood amidst media muscle of the vested interets. There is a fine line between pandering to the media and the media actually doing its job and publishing its own exposes. Publishing Joe Falzon's comments is not enough. He too at the end of the day is a 'vested interest' of sorts. How come in all these years of MEPA related controversy I have never read investigative analyisis of Mepa's workings in a nnewspaper - explaining to the lost bewildered public how this most maligned of entities actually works, its successes and failures etc. Instead we rely on articles by architects, politiciuans. This is not enough

The MEPA audit office itself should not be disbanded but the present officer has made his position untenable by his posturing and double standards.

In the space of a few days he has seen fit to launch a crusade against the law courts, one of the pillars of any democratic society, the Ombudsman's office and now the Planning Appeals Board. Perhaps we should leave the administration of the country exclusively in his hands!

He harps about 'illegal' meetings at MEPA whilst admitting to attending such meetings himself in the past. He cries wolf whenever he is asked to investigate an ODZ application whilst having approved, as chairman of the DCC in the past, over 1400 ODZ permits himself.

I along with others who wishes to do a proper job are suffering great financial hardship because in a Govt entity which is compared to M E P A for its Eff / Inefficiancy and proper control there seems to be Never a Person with enouph gutts to put his foot down . Amazingly when one considers the highly acclaimed personell in the local scene and having been involved within the board for a couple of years within the entity mentioned one cannot help feeling Hopeless and loose all sense of civil inclination.
If there is a lawyer / firm who is ready to take up a case against the govt please let it be known on this blog
Shame is something the authorities do not care about ..............If I am ok I do not care....... otherwise I won't be left alone to do my thing .

I am sorry to note that the attacks on Prof. Falzon have been escalating over the last few years and I sincerely augur that he continues doing his work - despite the lack of resources and the hostility.

If the current administration is serious about its promise of reform of the planning process and its statements on the need for greater transparency, it is now an immediate requirement to move MEPA's Audit Office out from MEPA and shifted under the Office of the Ombudsman as has been proposed in the planning process white paper issued some months ago.

If this is not done, it will further reaffirm the impression people like me have that all the talk of commitment to transparency and integrity are nothing but hot-air aimed at quietening down - albeit unsuccessfully - the public's disillusionment with the planning process as it it today. Attacks on NGOs, objectors and, above all, the MEPA Audit Officer do nothing but prove all this.

I took note of what the PM is stating here and find his comment to be 'not negative'. He seems to be objecting to the way the auditor goes about things: formal procedures.

Mr Falzon is mulling resignation because he is losing credibility. How can he set a principle not to investigate cases on which an appeal is still pending, and then all of a sudden reverse this principle 180 degrees? He is also contradicting Ramblers' defence where they stated that Mr Falzon did not know an appeal was being filed. He stated the opposite - that he decided TO GO AHEAD WITH THE REPORT BECAUSE AN APPEAL WAS FILED. Who are we to believe? So, is the Audit Officer now trying to interfere with the operations of the Planning Appeals Board, an independent board very much like the Law Courts? Because this is what he is implying through this criticism of the Appeals Board. The Audit Officer can only investigate MEPA - he cannot investigate or interfere with the Appeals Board. The same thing can be said when he said he did not exclude corruption in the Mistra case. He need not mull his resignation. His own contradictory arguments are obliging him to resign.

WHY are GonziPN & Regime and MEPA`s Big Heads, SO AFRAID of Mr. Falzon`s publishing of his report, probing a `stinky` development permit, in this case, in Qala, Gozo...!!!???!!!???

WHO is really being `Hurt`, `Disturbed`, `Afraid`, `Scared`, etc. etc.. by this report... TELL US PLEASE... WILL YOU....!!??!!?? WHOOOOOOOOOOOOOOOO.........!!!!!!!!!!!!!!!!!!!

The concerted attack on the Mepa auditor is clear proof that the targets cannot take the flak.
So they rustle up a motley crowd -- ex-Mepa big wigs, current Mepa big wigs, one or two expert manipulators of Mepa rules and the odd prime minister. Of course, no one is suggesting that the auditor should pack his bags; that would not conform to the usual practice of stabbing in the back. But cannot the auditor be dismissed? Does he have no chink in his armour of the type (fixed term contract) that did for that other 'pest' Carmel Caccopardo? Or do his masters not have the guts to dismiss him?
Mr. Falzon should stick to his guns; for what it is worth he has the full support of many people inside and outside Mepa. He has himself pointed to the hypocrisy of critics who would forbid audit of a case under appeal: that in case the objectors carry the day, they will
be presented with a fait accompli, as the developer was not barred from going on by the appeal.

Mr Falzon the country needs more persons like you who can stand up for what is right and are not afraid to take on persons who want to control this country in defence of the common good. These persons are trying their best to make your life miserable, but hang on. Please do not resign. You have the majority of the people behind you.

It is Dr.Gonzi and MEPA officials that should step down and not Mr.Falzon!!!

If Dr.Gonzi and MEPA are making such statements than it clearly means that Mr.Falzon is doing his Job right! Something which us citizens have been long waiting for!

Dr.Gonzi, were is the MEPA reform? will you leave it until before the next general elections? And for what reason is it taking so long? is it because of the few, to give them time to suck all they can from our limited Land? This was one of the prmonent promisses that got you into power again. So if you do not keep your word soon, you should step down and not Mr.Falzon who is clearly doing a good Job!

It is so ironic that those truly defending the environment are lambasted and pushed to leave, whereas those participating in one-on-one meetings with developers (without keeping any minutes) find the Dr. Gonzi ready to defend them.

Dr. Falzon you have the support of all honest Maltese who are not obsessed by partisan politics. I truly hope you don’t resign.

So first Dr. Cacopardo was removed, now they are close to eliminate Dr. Falzon.

This would be another huge loss for Malta and a victory for the developers.

Dear Dr. Gonzi the MEPA reform has to start from the people involved in the planning process. Without people with the credibility of Dr. Falzon the reform will give no results and your electoral promise would in practice have failed to materialize.

I hope Mepa's Auditor does not resign, as he is one of the few people who cares about Malta and is in a position to do something to slow down Malta's Uglification.

Mr Falzon should stay ,he is on the high moral ground.
Perhaps next time he should first hand in the report to the Prime Minister and discuss it with him.
On the other hand the Prime Minister should heed to Mr Falzon's advice regarding the loopholes in the issuing of building permits and include them in the much awaited MEPA reforms..
The auditor knows the ropes and it would be a great loss for the Prime Minister and the country if he resigns.

Prof. Falzon, please stick it out. You have all our backing and you are one of the few bright spots in the local scene at present.

It is not you who should resign, but the present and past MEPA boards who handed our environment lock, stock and barrel to the developers.

If the PM wants to make MEPA and himself more credible with the general public he should swallow his pride, remove the current Mepa chairman from his post and install Perit Joe Falzon as MEPA Chairman. Only then can we expect a general clean-up of MEPA., full transparency and a body that truly safeguards Malta's environmental interests. And you, Dr Gonzi, can then rest assured that the MEPA reform will truly happen.
