Gun failed to go off during fight, court told
Steve Spiteri, 27 of Siggiewi, was today jailed for three years for the attempted murder of Ronnie Spiteri, of Birkirkara, in a fight in Paceville in October 2004.
Police constable Christopher DeBrincat said he had been on duty in Paceville when he was called to investigate a fight. The two men had first started to argue but he then saw Steve Spiteri try to draw something from his pocket. His girlfriend tried to stop him but he still managed to draw a .38 revolver. Holding the revolver from the barrel he repeatedly hit Ronnie Spiteri on his face. He then turned the weapon and pointed it at Ronnie Spiteri.
The policeman said he held the accused and tried to take his weapon. Steve Spiteri still managed to pull the trigger but the gun did not go off because of a fault.
Police reinforcements then arrived and the weapon was confiscated during a struggle.
Magistrate Consuelo Scerri Herrera said the court found the accused guilty of attempted murder. It also noted that the accused had previous convictions of theft and assault and he had not learnt his lessons.
He was therefore being jailed for three years.

On must appreciate the difficult circumstances the police find themselves in Paceville although in the public eyes they are not doing enough, I can vouch that the police try to do their best with the limited human resources compared to the hundreds of revelers and have to act in a professional way when dealing with drunken crowds, rowdy behavior etc..
Police are a target for criticism from a number of entities for not doing enough, One must also keep in mind that the police are often faced with allegations of manhandling in such circumstances . it is easier to criticize the police. one has to be in that situations to realize how difficult it is for such situations.
the courts must must not be lenient in such circumstances and should have imposed a stiffer jail term. The trigger was pulled and did not go off because of a fault, Culprit had the intention to perform a heinous crime .

What a Joke!!! Attempted murder gets you anywhere from 10 to 15 years in the States, and sometimes more. Times have changed, guns are more easily acquired then ever before. The laws need to change accordingly. When is Malta going to join the 21st century????

Simply appalling and ludicrous. It's no wonder the Police are reluctant to do their job when the Courts are ridiculously so lenient towards such a crime and to top it all, a repeat offender. Now we know why crime is on the increase. Life has no value anymore according to the Maltese Courts. There is no real deterrent and it's coming straight from our Law Courts for God's sake !!!

You can't actually find somebody guilty of murder if the intended victim is still alive. That's why it's called ATTEMPTED murder: he attempted, but didn't succeed.
Apart from that, the sentence seems a bit on the lenient side.

wow really a farsa. and it didn't mention that he could have hurt a lot of people as paceville is too crowded and its possible to hit someone else in a struggle. farsa ta veru 3 years u l pulizija jirriskja hajtu ehh. peress li andu d danger money (naf li ma andux la danger money u lanqas shift allowance)

I really hope that, the "therefore" was added by the Times and not by the Magistrate.....otherwise it should have been at least 30years for trying to kill a P.C. on duty!! Does the mag think he will be learning his lesson with just 3 year slap on the wrist for attempted murder?!?

this case should not be considered as an ATTEMPTED murder... this guy PULLED THE TRIGGER!! if the gun didn't malfunction, the victim would have been killed!! he should have been convicted of murder & sentenced to life!!

3 years for attempted murder, carrying a conceald weapon, endagering the public and since he has previous convictions for theft and assault (repeat offender) I would also conclude that he would not be allowed a gun licence (then again seing how law enforcment works here I may be wrong), so that would be owning a firearm without a licence.

MMM - So carrying a hand gun in the street and in a bar, then trying to kill someone with it gets you just 3 years in prison (2 with time off for good behaviour)!
No wonder only the 'legal / court personnel' have any respect the dysfunctional Maltese legal system - what a joke.
