Aldo Portelli (September 7) made reference to the court case I had instituted against the Pietà local council and stated that I had won the case because the court had concluded that the reserved parking scheme had not been approved by the ADT.

He further stated that now that the ADT has approved these schemes, they can be applied in every locality.

Conveniently, he only mentioned part of a sentence whereas the court had also declared that "l-impożizzjoni ta' żona riservata għar-residenti hija ultra vires is-setgħat mogħtija lill-kunsill, minbarra li hija miżura preferenzjali". (The imposition of a reserved zone for residents is ultra vires the power given to the council, apart from being a preferential measure). The court further remarked that whoever pays the same amount for the road licence is entitled to the same rights. The court also ruled that should these schemes be implemented all over the island we would no longer be citizens of one country but citizens of 60 countries.

The fact that the government has deemed it fit to publish a legal notice authorising the ADT to approve such schemes does not alter the fact that these schemes are no longer preferential but they were and still are discriminatory.

I shall be filing a new court case requesting our courts to declare that the latest manoeuvre by the government is still a discriminatory and illegal imposition. I shall also be circulating a petition to be signed by all those who are against the imposition of these schemes and anyone who is willing to join may contact me on jpborg8369@gmail.com.

In the meantime, I suggest to car owners who might be booked for parking in these reserved areas to settle the penalty under protest by effecting payment through registered mail while awaiting the outcome of my new case.
