Bahrija case back before Mepa tomorrow
The Malta Environment and Planning Authority will tomorrow consider the modification/revocation of the controversial building permit issued for the redevelopment of a dilapidated dwelling at Wied Tal-Marca. Bahrija.
The case will be reconsidered in terms of Article 39A of the Development Planning Act.
Article 39A gives Mepa the right to revoke permits in particular circumstances, including 'when there is an error on the face of the record that offends the law', such as when wrong information is given to the authority.
The chairman of Mepa had already declared in reaction to the Mepa auditor's investigation of the permit that the applicant had been notified of the authority's intention to apply article 39A for the withdrawal of the permit because it was issued erronously.

Have they found the original files yet, the ones that conveniently went missing from Mepa’s archives!

That's what I'd define open-ended terminology. More clear definitions are certainly needed!!
All eyes will be on MEPA. May good sense prevail.

So, based on the Chairman's declaration that according to the findings of the Mepa's Auditor's investigation, the permit was issued "by mistake" because Mepa had been fed wrong information, could the powers that be illuminate us on :-
JUST WHAT, PLEASE TELL US, WHAT IN HEAVEN'S NAME IS THERE TO RE-CONSIDER ???
Hope the active NGO s will be present for the hearing, to save the valley..........
