Dr Frank Portelli has filed a court case to annul a decision by the Medical Council to erase his name from the medical register unless he pays a fine.

The decision was over a letter Dr Portelli wrote to Dr Louis Buhagiar in his capacity as hospital CEO on July 16, 2003 informing Dr Buhagiar he was being suspended from St Philips Hospital because of “repeated complaints we had received about the professional fees Dr Buhagiar was charging patients”.

Dr Portelli is claiming that the Medical Council did not have jurisdiction over the CEO of a private hospital and the letter suspending Dr Buhagiar was written in his capacity as CEO of St Philips.

Moreover, the Medical Council failed in its function as obliged by Law to conclude the inquiry within a period of two years.

Dr Portelli is also claiming that the decision against him wrongly referred to Legal Notice 39 of 2009 which pertained to Commissioners of Justice (CAP. 291) Petitions (Local Tribunals) (Amendment) Regulations, 2009 and not to the Health Profession.
