MEP candidates' overspending controversy ends in court

MEP aspirants spent a lot of money on colourful leaflets during their campaign.

Two European Parliament election candidates yesterday filed a judicial protest calling for an investigation into the expenses of those who contested the June 6 election.

Imperium Europa leader Norman Lowell and Emy Bezzina, from the Alpha Liberal Party, protested against candidates' overspending, a controversy sparked by a series of articles in The Sunday Times, which revealed that at least eight EP contenders exceeded the spending cap.

The newspaper has been insisting that the six elected MEPs give a detailed account of their campaign costs but they have so far refused.

Mr Lowell and Dr Bezzina claimed several of the candidates, including the successful ones, had breached the legal budget limit of just over €18,000. The protest was filed against the Prime Minister, the Opposition Leader, the Attorney General, the Chief Electoral Commissioner, the Police Commissioner, the European Commission Representative Office, the Office of the European Parliament in Malta and the Foreign Minister.

Addressing the press opposite the law courts, Dr Bezzina said investigations into the candidates' expenses could only be launched at the Attorney General's request and they were asking him to do his duty and order the Police Commissioner to probe the candidates' expenditure.

Dr Bezzina said a court case would be instituted against the Attorney General if he failed to initiate an investigation.

Mr Lowell and Dr Bezzina said that if the law was broken, the election should be annulled in terms of the electoral law. None of the elected MEPs should be sworn in before the investigation was concluded, they insisted.

The two candidates, who failed to be elected, asked the authorities to investigate all spending including advertising and promotion on newspapers, online advertising, mail shots and billboards.

The Prime Minister and the Opposition Leader were asked to disassociate themselves from the alleged abuses.

Mr Lowell called on the President to take action, saying this was his first political test.

On Sunday, two unelected candidates, Alan Deidun (Nationalist Party) and Claudette Abela Baldacchino (Labour), accepted a request by The Sunday Times to have a journalist present while taking their oath. Both declared they spent well below the legal limit.

The electoral law states that candidates cannot spend more than €18,635 on the campaign, including personal expenditure and that by third parties whether financial or in kind.

If the limit is exceeded, it was possible candidates would not be allowed to serve if elected. If not elected, the person was liable to a fine.

For the past six weeks, The Sunday Times had been chasing candidates to disclose the cost of their campaigns.

PN candidate Edward Demicoli openly admitted he had overspent by more than €30,000 and said he did not wish to make a false oath.

Candidates have up to July 17 to declare their expenses to the Electoral Commission and make an oath.

When taking the oath, candidates may choose to do so privately with a notary of their choice. Since no commission representative will be present to verify the oath-taking, The Sunday Times had asked candidates from the two main political parties to grant access to a journalist.

Dr Deidun and Ms Abela Baldacchino were among seven candidates from the two main political parties who accepted the request. PN candidates Edward Demicoli and Rudolph Cini agreed as did Labour candidates Christian Zammit, Maria Camilleri and Steve Borg.

However, the six elected MEPs have so far refused to agree to the newspaper's request for a disclosure of expenses and have denied access to witness their oath.

You have got one brochure missing in the picture that was as costly and bombastic as that of the MEP’s. That’s why I am in full agreement with the comments expressed by Mr. Formosa and Borg. This judicial protest by Norman Lowell and Dr. Emy Bezzina should not limit itself just to the MEP’s overspending but also to the local council’s election campaigns. They too are bound by the same legislation and that’s why the investigation by the Electoral Commission and the Police Department should seriously be carried out as requested by other progressive candidates. This candidate whose name has been in the lime light for other bad governance has lavishly spent more than any ordinary MEP. Unfortunately if nothing is done to stop this charade we shall have people representing us in high institution solely because they had the means to spend spend spend.

I am in full agreement with Messrs. Bezzina and Lowell. These elections are a sham and the same applies to our General election and this is more serious. In the European elections those elected will have minimal relevance to what happens here, they want to get onthe gravy train. Good luck to them.

IN the General Election we are choosinga Government that will effect all of us and certainly people who give donations to candidates and parties excpect something in return, they are not doing this for charity.

if the Labourt Party wants to do something it must be at the forefront of the battle to have a law regarding Party financing and the expenditure in elections.

A lot of people will be taking a false oath and yet nothing happens.

Prost mill-qalb Mr. Lowel u Dr. Emy Bezzina. At long last some courageous citizens came forward to defend our Island's democracy. The People's representatives should not be elected on the money strength, but on candidate’s integrity and honesty. But let's give everybody his due. The first paper who mentioned this abuse was the Sunday paper ILLUM, to be precise one week before 6th of June Elections, and it was in connection with the overspending of a certain candidate for the Local Council Election. It refers to a candidate from Marsascala, where residents had asked the Commissioner of Police and the Electoral Commissioner to investigate the overspending of this candidate. I repeat this was one week prior to the local councils elections. It appears that both the Chief Electoral Commissioner and the Commissioner of Police failed to investigate the claim put forward to them by the residents. U issa l-froga saret.!! Ta min hi l-htija? The residents who alerted the Authorities or the Authorities who ignored their claim? F'gieh id-demokrazija qumu ftit minn naghsa u ghamlu dmirkom.

Well done Mr. Lowell and Dr. Emy Bezzina. I did not vote for you for the MEP elections of the 6th June, but I fully support you on this important issue. The law is there and it should be abided by all candidates. What I do not agree with these two gentlemen is the fact that they are limiting themselves to the election of the MEP's. Why are we ignoring the election of local councils? The Electoral law refers also to the local council elections. There are cases which have been mentioned in the local papers of certain candidates standing for the LC Election that have spent thousands of euros. The Attorney General who is finally responsible to see that laws are followed by everybody must accept without any hesitation the request made to him by Mr. Lowell and Dr. Emy Bezzina and order the Commissioner of Police to make a serious investigation regarding the overspending by candidates who contested for both MEP election and local council Election. If the Attorney General fails to accede to this request he will be considered as an accomplice in the deteriorating state of our country's democracy.
