Company claims copyright violation

A company filed a judicial protest in the First Hall of the Civil Court claiming that their copyright in an internet website had been violated by two men.

Commercial Service Bureau (CSB) filed its judicial protest against Simon Ciantar and against Vincent Mercieca.

The court was told that CSB had a website - www.csbgroup.com, on which it published information including reports, memoranda and similar matters related to the commercial services it offered.

The two men had set up another internet site under the name www.sciantar.com. This site was separate and distinct from that owned by CSB.

However, CSB told the court that Mr Ciantar and Mr Mercieca had copied part of its site and pasted it on the site they owned.

It further resulted that Mr Ciantar and Mr Mercieca had mistakenly included CSB's name on their website and CSB said that this was an evident mistake the two men had made when they copied from its website.

CSB called upon Mr Ciantar and Mr Mercieca to immediately regularise their position and to make good the damages it had sustained.

Lawyer Andrew Zammit acted for CSB.
