Q: In October 2007, I purchased an electric built-in oven. Every time I used it, I noticed that a lot of steam came out of it and that this steam turned into water on the top cupboard, which then trickled over the underneath cupboards and down to the floor tiles.

I called the shop where I bought the oven from, explained the problem and it was agreed that they would send over the technician to check it out and solve the problem.

Since the first time I called the shop, the technician came seven times to my home, and even took the oven to the workshop to carry out the necessary repairs. During this period, the sensor of the oven was changed, its fan fixed and temperature checked. Since then, I called the shop to report another problem and specifically asked for the oven to be replaced. In the meantime, due to the steam problem, the oven's paint started to peel off too.

Do I have the right to request a replacement? If yes, once this oven is replaced, does the commercial guarantee start from scratch?

A: Yes, when the product purchased is defective, by law the seller is liable to provide a remedy. The remedy could be either repair or replacement. In your case the repair has been carried out several times, but unfortunately did not manage to solve the problem.

Moreover, all these repairs have caused you a lot of inconvenience.

Therefore, you are legally entitled to request a replacement of the defective oven.

If this solution is not possible you can even request a part refund of the price paid or revocation of the contract, that is, a full money refund.

With regards to the warranty, the answer is no. The replaced oven won't carry with it a new warranty because a new guarantee is only given with a new purchase.
