Updated: Man jailed for six years
Charles Demicoli, 34 of Birzebbuga, was today jailed for six years after having been found guilty in a trial by jury of participating in a fight in which a Filipino sailor lost his life.
Mr Demicoli was found not guilty of murder.
The 8-1 verdict was returned by a jury this morning and sentence was delivered by Mr Justice Geoffrey Valenzia. The four months which the accused spent in preventive custody will be deducted from the sentence. An appeal is expected to be filed.
The Filipino died during a fight which broke out at Cherries Bar in Birzebbugia on Christmas Eve, 2000.

The jury system is the best system as the jurors simply have to decide according to the evidence presented.
They are unknown to anyone prior to the jury and thus all sorts of foul play are eliminated.
This is certainly not to impinge upon the integrity of our Judges, but better to be careful rather than sorry.

Not only this sentence was too short but I believe, after reading about the case, that more persons should have been arraigned following that day's fight. We live in Malta not in Congo or we do not?? Someone's son was killed that day who was in Malta to earn some money to send to his family not a cockroach, then we complain that it's not safe anymore to go out for a drink or to drive your car!

The jury system is the best in the world camilleri.
The jurors are chosen from a number of citizens and are not known before.

Mr Demicoli was found NOT guilty of murder then .... why was he jailed??? Besides, what about the murderer? Is he still on the streets? Somebody did kill him, so who is the guilty guy?

I would suggest that over 6 years to come to trial is rather slow , is it not? How can witnesses remember details from so long a time ago? are there not enough judges in Malta?

The trial by jury system has been giving us awkward results and it is about time that a trial by three Judges will replace it. Many times the jurors have been wanting in their judgement.

how come that only one person has been jugded when a whole lot of people has taken part in the fight? From the articles on the times, this person was only involved in part of it and the other lot of people, where involved more!!

Mr Demicoli was accused of the voluntary killing of this person, when in fact there were several other persons involved who all contributed. It would have been a disgrace had the jury found him guilty. Mr Demicoli happened to be at the wrong place at the wrong time, and certainly made a mistake if he really threw the object at Mr Montalban, but he certainly didn't kill the man, and had no intention of doing so. His voluntary intention to kill had to be proven beyond doubt, and there was not enough evidence because there was no such intention. People who do not know Charles Demicoli shouldn't judge him as another 'lucky guy' whose lawyer managed to convince the jury.

Accidental what? this man was beaten, hit and what not and you call his death accidental? He was murdered. No one beats other people on their head with a stool just to joke with them. And on top of it all murder happened on Christmas Day.

How can the term "accidental death" be used. The very case is Mr Montalban's murder and not accidental death. This was a case of murder and someone killed this man, intentional or not. Where does this case go from here ?
