Driver wins over €20,000 after collision
A man was awarded over €20,000 damages following a traffic accident in Marsascala in 1997 which left him with an eight per cent disability. Alfred and Connie Grixti claimed that Mr Grixti had suffered a permanent disability as a result of a collision.
A man was awarded over €20,000 damages following a traffic accident in Marsascala in 1997 which left him with an eight per cent disability.
Alfred and Connie Grixti claimed that Mr Grixti had suffered a permanent disability as a result of a collision. Mr Grixti was driving his car along St Anthony Street, Marsascala when Kevin Pace, who was coming from the opposite direction in a Porsche, lost control of the vehicle and crashed against his car.
This version of events was corroborated by the brake marks on the site of the accident.
However, Mr Pace said he should be paid damages because the collision had been caused by Mr Grixti.
Mr Justice Raymond C. Pace concluded otherwise and, considering that Mr Grixti suffered an eight per cent permanent disability as a result of the accident, ordered Mr Pace to pay him damages amounting to €20,204.03.
