Jailed for raping 10-year-old girl

A 61-year-old man was jailed for nine years after a court found him guilty of raping and physically abusing a 10-year-old girl in 2003.

The man, who cannot be named by court order to protect the victim, was charged with raping and abusing the girl while on a suspended sentence.

The man was the partner of the girl's mother, with whom he has two children.

A social worker from Appoġġ said the girl had phoned Helpline and spoke to her headmistress about the abuse she had been suffering at home. She was subsequently removed from her mother's house and taken to a Home.

Testifying, the girl gave a very graphic and disturbing account of what had happened to her over a period of four years.

Aged four the accused had come to live with her family. The first time she was abused was when she was six. At first, he would call her names and hurt her.

He then started touching her and the frequency of the abuse increased reaching a peak of six times a week. The girl said she had told her mother what was going on but it seemed that she didn't care and instead believed her partner.

The girl said she would tell the accused she did not want to do what he wanted her to but was threatened that he would beat her if she refused.

The man admitted in court to viewing pornographic films in the girl's presence and that he had her touch him while watching the films. He did throw things at her, like, say, a mug but he never meant to hurt her.

The court ruled that the prosecution had proven well beyond reasonable doubt that the accused was guilty of the crime he was charged with. He was, therefore, found guilty of raping the girl, corrupting her and committing a crime within the operative period of a suspended sentence.

He was acquitted of the charge of holding her against her will.

Magistrate Audrey Demicoli took into consideration the fact that in 2003 the accused had been given a two-year jail term suspended for four years on being found guilty of theft. He was jailed for nine years, including the twoyear suspended jail term which became effective.

Police Inspectors Louise Calleja and Kevin Farrugia prosecuted.

He should be locked up and the key thrown away. Her mother does not deserve custody of her children, if she is not there to protect them.
The court should investigate if the other children were also abused.

HE NEVER MEANT TO HARM HER!!!

This man repeatedly abuses a child physically, psychologically and sexually....... and he says he did not mean to harm her!!!!!!
He deserves a dose of his own sick medicine.
And has for the "mother"!!!!!!! She is a disgusting specimen of "motherhood"!!!!

How can one get 9 years for raping a child, 2 of which were for a previous case? And the mother must have no heart to ignore her daughter. I'm sorry but I find this very unfair. I dread to think what I would do if I found out that someone raped my daughter, but I would not settle for such a short sentence, and I would definitely not ignore my little girl..
I think that the sentence should be harsher and that the mother should get done also.

This is outragious. if this is the maximum according to law; then Government should revisit the law regarding child molesters, possibly introducing chemical castration as is done in certain Nordic countries.

The mother should be convicted and the man should get at least 25 years for his perverted actions..

I cannot understand why the court does not publish the identity of these people. After 9 years. like others, this guy will be back again in society repeating the same things.

Right, so this guy was on a suspended sentence, raped a 9 year old girl for 4 years, for as many times as 6 times a week, and he got away without being named and with a 9 year sentence.

Somehow I imagine raping a child is a bit worse than dealing in drugs, yet we name and shame drug dealers and lock them behind bars for 15-20 years.

Now, when the accused was found guilty, the mother of girl must be prosecuted for letting that happen. Girl should apply to a Civil Court to get money for Psychological damages from the abuser.
She must prove to Civil Court how the happening affected her psychologically, and what damages exactly she had received and what money exactly she requests to cure her damages.

Do you know that in other countries people can seek in Court the refund of Moral damages, but not in Malta...

Oh no....I am speechless. I hope that Inspectors Louise Calleja and Kevin Farrugia have placed an appeal already. 2 other minors must be taken under care order just the same, mother must be prosecuted on several grounds.

When it was discovered? Back in 2003? she was 10 in 2003 and 6 in 1999? Did court take 5 years? And all 5 years accused was happily living with the mother of raped girl, raising 2 other children? Did I get it right? Now she is 15, she spent 4 years in hell, another 5 years in Angela Home, waiting for justice to arrive, to find out that he is given 7 years for having a little child as sexual slave for 4 years.

Lady Justice was not only blind, she was completely deaf...not to hear this child crying loud for such a long time
