Man accused of causing toddler's death through negligence
Francis Mamo, 53, personally and in representation of Oman Construction Ltd, was this morning arraigned in court and accused of the manslaughter of a two-year-old boy who died when he fell down a shaft in Zebbug.
The boy, Gabriel Agius, fell a height of one storey down the shaft in the common area of a number of garages on April 16 at about 1 p.m.
Mr Mamo was accused of causing the death of the toddler through negligence.
He was also accused of having, on previous occasions, ignored warnings to remove danger to the public on building sites in the same street.

Whatever the case, an innocent life has been lost, worst still a little child. All this and many other senseless deaths and injuries could be avoided with so little effort. If only there was an "undo" toolbar as on my PC and all wrongs could be reversed. I have been at too many a construction site and finished shells where such dangers are everywhere, even on finished premises as unfortunately was for little Gabriel's case. RIP Dear Gabriel.

We are judged in the same way we judge. The name of someone who raped a 10 year old girl isn't mentioned, whilst the name and company of a man who still isn't proven guilty is mentioned..

I agree with police action. (not guilty until proven).
Abuses, especially in the construction building are so widespread that you can see them by the hundreds !!!
The govternment should see that the Authorities concerned (by giving them manpower from other OVERSTAFFED departments are trained and manned properly. Because here we are talking about loss of life and limb - dearest loss.
I have reported some times of certain irregularities because everyone should have the human conscience to report - even in other different situations - whatever it is - the well known

Ex. why on this lovely country WARDENS are still not being given the stop signs like all other countries in the world. Why am I supposed to see a warden making 'a WAVING sign' to move (it could be from 300 feet away !!!!!!) - it could be raining / shinning (whatever) -
WHEN a ONE EURO PLASTIC sign can be given to the odd 200/300 wardens ? besides showing seriousness - let's prove SMART MALTA.

The mentality present in Maltese society of 'Mhux xorta' is the ultimate problem.
This is the very reason why strong penalties need to be in place to ensure that these things d not happen. Unfortunately nothing can be done to bring little Gabriel back, that tragedy is done, culprits MUST pay but the trick is to make sure that it does not happen again.
Even small things like litter may have dire effects - think rain and flooding of roads. The small 'mhux xorta' items need to be adressed for the benefit of all.

I believe that people like Mr. Mamo should not be named before proven guilty!
From your comments one can easily note that you have already judged this human being! Who are we to judge?

What happens in such cases is that if found guilty, the accused will be reprimanded and fined. The child's life is lost forever and the parents spend the rest of their life without their much loved baby. And the story repeats itself. A harsh punishment will set an example and serve as a warning.

When is going to be a law which says that a safety officer should inspect a new building site and certifies that it is up to basic safety standards before it could be used as a residence for people and make smoke detectors and fire alarms and other safety features obligatory as it is a norm in most EU countries or we just have the prices to the same standards of the property abroad!!?? Ok tragedies happen everywhere but its always better to reduce the risk and learn from others!

There is much more that could be done to prevent accidents. I would also hold the authority’s inspectors responsible for not doing their job properly.
The law should be amended to force the courts to suspend the operators’ license. Many abuse – in every sector of our economy – because the courts are lenient and it sends the message – CRIME PAYS.

What we are missing is discipline. All departments, especially those involved with construction should strictly enforce safety laws by imposing heavy fines on those who ignore them.

Not referring to this particular case, but it is about time that these people are held accountable for treating health and safety issues as a nuisance!
This happens mostly on the smaller construction sites as can be seen all over the Island!
