GO seeks retrial of pensions case
GO plc has filed an application for a retrial following a judgement by the Court of Appeal on July 7 relating to former Cable and Wireless employees.
The court found that the employees were eligible for pension payments from the company.
The company is also seeking a suspension of the execution of the judgement pending the retrial application.
The company had said in August that the total cost for implementing the pension scheme in terms of the Court of Appeal judgment was expected to be in the region of €13.16 million.

shame go and gonzigattpn! go are seeking to be freed from their obligations! have go returned the Qawra ground with a market value of more that 23m euros? What the gonzipn is doing to secure the people's right?

Section 811 of the Code or Organisation and Civil Procedure permits a retrial only in a very small number of instances.
A mistake in your arithmetic is not one of them.

These are men in their 70s and 80s who have been going up to court for several years only to hear 'case postponed' time and time again.. A true travesty of justice. As Mr Tabone says a due diligence was done and if GO did not do their homework, no one else is to blame but themselves. Does GO realise their credibility is at stake here? loss of customers? Shame on the company for trying to postpone once again a case that has been tried , a verdict reached, and an appeal lost by GO. A true sign of what justice is like in Malta.

Well said K. Abela. The story of this case goes back to 1974 when telemalta was still a Goverment owned entity! Why should current owners/shareholders be liable for such a mess?

Because just like a normal heir who inherits his inheritance and it is said that s/he steps into the shoes of the deceased, when a company takes over it similarly steps in the shoe of the previous company and assumes both credits and debits Mr Abela.

When a company is bought, a proper due diligence is required. One has to have a look at how the purchase was carried out, and its terms to be sure. But when one buys a company with its underlying assets and liabilities (which is sometimes the case), this also refers to any liability which was incurred but was not identified and reported at the time of purchase.
Therefore just like GO is benefitting from the assets that were bought, it should also incur the liabilities that were "bought", if this was the case.

Why is the shame on GO? The shame should be on the Government who at that time controlled GO. Why should the new owners and abused shareholders be liable for a problem that should have been handled by the Government when the company was still Cable and Wireless??

Go should be ashamed of themselves for prolonging the suffering of these employees who have been fighting this case for years.
Go is just waiting for them to die one at a time before justice is finally done??
