The Court of Criminal Appeal has upheld a request by the Attorney General that the courts re-hear a case in which a man was fined €465 for storing fireworks in a building near Mellieħa.
The Attorney General's Office had filed an appeal claiming that the Magistrates' court should have heard evidence and that the punishment was too light.
The Appeals Court, presided over by Mr Justice David Scicluna, found that despite the guilty plea filed by the accused, Anthony Caruana, evidence should still have been heard.
It, therefore, upheld the appeal by the Attorney General, declaring the judgment null, and sent the case back for re-hearing.
