The Civil Court this morning upheld a request by One Telecom Ltd to ban One Productions Ltd from marketing its mobile phones service under the name One Mobile.

One Telecom Ltd had pleaded that the use of the name One Mobile would cause confusion.

One Productions said it had been using the trade name One for various activities for years and had always been associated with it.

The Court established, however, that while One Telecom was granted its trademark on July 18, One Mobile applied for its trademark on August 22.

The court , presided by Mr Justice Alberto Magri, ruled that using a trade mark One Mobile would cause confusion with the trademark 1 Mobile owned by One Telecom.

Dr Adrian Muscat Azzopardi was legal counsel to One Telecom.
