An appeals court has confirmed a jail sentence on a man convicted of the possession of Ecstasy pills, finding that the fact that the man was diagosed with HIV was not a valid reason for the sentence to be altered.

The man filed his appeal after the First Court sentenced him to five months in jail and a fine of €600. In his appeal the man said the sentence was excessive. He also pointed out that he was suffering from HIV, a potentially fatal condition.

Chief Justice Vincent DeGaetano said that the fact that the man was a HIV carrier was not a valid reason for his sentence to be altered.
