If you happen to reside or work abroad or have the funds to establish legal residence you can obtain a definitive legal settlement of your matrimonial situation through divorce, whereas if you do not want to leave your life and work in Malta or do not have the funds to establish legal residence abroad you cannot. Can this be a rational or just way forward when foreign-obtained divorce is recognised in Malta anyway? Surely it is time for Malta to consider a restrictive form of divorce law akin the Italian one which has been around for decades? Of course, nobody should argue for the right to remarry in Church as that might seem hypocritical. On the other hand it is the state system that appears to be hypocritical here.
