Updated: Mistra investigation: Police proceed against three persons
The police have started legal proceedings against three people following their investigations into the granting of a permit for an open air disco in Mistra.
In a statement, the police said the Economic Crimes Unit has filed cases in the Magistrates' Court against Philip Azzopardi, 57 of Naxxar and Anthony Mifsud, 50 of Birzebbugia over alleged private interests in an adjudication process.
Another case was filed aginst George Micallef, 48 of St Julians over alleged false declaration and violation of the Planning Development Act.
Informed sources said the police had decided, in consultation with the Attorney General's Office, there was no case against Nationalist MP Jeffrey Pullicino Orlando.
Mr Azzopardi and Mr Mifsud are former members of the MEPA Development Control Commission and Mr Micallef is a former consultant to the Malta Tourism Authority.
Dr Pullicino Orlando, who had repeatedly said he did not wish to comment while the investigations were in progress, said when contacted this evening that he will issue a detailed statement tomorrow.

This habit of mudslinging in local politics must stop. I remember a similar case in the 1980s when the PN used to constantly accuse the then minister for public works, Lorry Sant of corruption. He was even arraigned in court but acquitted. He must have been also innocent.
Perhaps if Labour had won the election, the outcome of the JPO case would have been different, who knows?

Remember the big story of Dr. Sant, his deputies, One TV cameramen in front of Police Headquarters after they had given the Commissioner 'evidence' of alleged wrongdoing by JPO ? They trusted the Commissioner then? And now the elves say 'we are not surprised of the outcome - NP rules'! What a confused bunch of people!
JPO did nothing wrong legally or morally. The moral part rests with MEPA and the DCC who are supposed to also defend the 'spirit' of the law.
The Police investigation proved that JPO is innocent and that the vindictive Dr. Sant was just throwing mud. Fortunately, most of it ricoheted back to his face.
We now wait for Part II when the libel suit against Dr. Sant is heard. Will he personally appear in court or send his lawyer to represent him ?

If this scandalous affair hadn't been brought to light before the Elections, Mistra would have been
ruined forever and the Green Politician of the Year would have been a much wealthier man. As for the investigations, nobody is really surprised at the outcome, the ostrich voters are vindicated and JPO continues to strut as a morally upstanding representative of the people. So what's new?

Well done JPO. May I remind all of you bloggers who jumped to conclusions well before this report had been published that this mud slinging has been going on for years. Remember the Cachia Zammit brothers years ago. They had their house ransacked by the police and even taken to court. Remember the verdict. NOT GUILTY. Ever since and before every election , this mud slinging has not stopped and not one person from the PN was ever found guilty. So please now accept the verdict, stop moaning and take a look at the what is happening in the MLP and the resignations.

The fact that people like Goorge Micallef were indicted with wrong doing is definitely no good news for you... we'll hear a lot in court under oath and this time it will not be mud slinging by AS and co. Obviously the case will be deferito ad eternum as usual.... and the beat goes on :)

This is the day Alfred Sant gave me the slip for the second time running and made his 'grand expose' at Mistra. I clearly said I knew what was being done with my land before Alfred Sant came out with his corruption allegations. I have now been subjected to an intensive investigation which has proven me to be innocent and Alfred Sant to be a liar. Let me remind you that I challenged Alfred Sant to go to the Police Commissioner with his allegations on the same day (ie 1/3/08) and he only did so to save face three days later after he made a fool of himself yet again by avoiding me during a PBS recording.

Excuse me but could someone explain this co-incidence of the police "investigations" being published exactly at the same time that the MLP leader and deputy leaders were elected? Could it be possible that in that way one can, from the start, maliciously blame these 3 new people of what had happened before? And why did it take over 3 months? One goes to the police because one trusts them but then, if there is no transperancy and no precautions are taken during investigations to make sure that no meddling of evidence can take place, then, yes, after 3 months, some suspicion and mistrust is expected, whether one is an elf or a clone, but not if one is an honourable gentleman or lady.

@ Labour's little elves and their clones: when Anglu Farrugia and Alfred Sant go to the Police with reports, it's presumably because they trust them to do their jobs. When the Police do their job, they suddenly become untrustworthy.
In other words, the truth is what the little elves and their clones want it to be and woe betide the Police or anyone else who does not agree with them.
Sorry elves, you're in the wrong, as usual, almost by definition, while the clones sometimes have to admit that they're not infallible, green and tree-hugging though their credentials may be.

Guys just because the attorney general felt that he should not press charges against JPO does not mean he is absolved from any wrong doing.Deciding so was just a point of technicality & not on the basis of innocence. Finally the truth will come out when these gentleman answer for their deeds in court and more importantly they have to answer for who they were working towards.

The matter should be subjected to a public inquiry, conducted by a judge with witnesses testifying under oath.
A decision taken behind closed doors by the Police and the AG is not satisfactory and will not convince anybody.

I suppose labour realized they had no chance to win so they had to stoop low enough to spread lies about people. I even saw billboards about this whole fiasco. They ought to be ashamed of themselves, for ruining someone's reputation just so they could win an election. Thank goodness they didn't win. This was a very very low thing to do, and I hope charges will be pressed against them.

I will believe what the competent authorities have said and not what One Tv dishes to those who come high or low will always believe that the PN is "evil", "corrupt", "dictatorial" bla bla bla............Both the Police Commissioner and the Attonery General have proved JPO to be innocent and cleared from any criminal implications...............

Thats why that in the lat week of the election Alfred Sant could not answer Jeffrey cause deeply he know he was right. All he wanted was to gain votes in the panic he was because third parties gave him false information.
conclusions with simple maths when in 2003 JPO got around 1300 votes in 2008 he got over 5200 vote... surely means that JPO MADE THE PN WIN THE ELECTION...

and why JPO cannot be innocent? just because alfred sant, had said so? the best thing that happened to malta so far, is that MLP did not get power, otherwise we would have the executive, the judicial and the legislator all in one person. Before we start hearing about virginity and honesty, let`s not forget that the JPO issue was about two things : the legal part and the ethical part.
As for the legal part (whether there was any legal wrong doing), in the judgement of the police and attorney general there was nothing wrong (although in thoery they should investigate, present the evidence they have to the compilation stage, and then a decision is taken whether there is enough prima facie evidence to proceed).
As for the ethical part - which means whether he was honest with his leader and with the public) JPO First said he didn`t know anything and accused Alfred Sant of fabricating a story ... then the contract with his signature came out, which confirmed that he was receiving rent and there was an obligation of what to build and who will be the final owner .... hence confirming that it wasn`t a fabricated story

This is typical of the MLP supporters. When the truth starts coming out they start accusing our authorities. This is how they always react even in non political issues. I perfectly agree with C.Camilleri that our courts should start hearing the libel cases immediately. This will prove how the MLP based his campaign only on mud slinging.

It's rather pointless to speak about who is morally blameworthy from the PN's side when there are surely loads of politicians from the MLP side that also fall into this category. Or should I say that there exists no such thing on that side of Parliament?
Morality is definitely not the issue here, because I have no doubt whatsoever that there is NO politician out there who is indeed morally 'clean'. Criminality and moral judgement hence stand in two different lights - criminality must be punished (and the police have established that there are no criminal acts on JPO's behalf), while morality cannot. Making an argument based on morals is about the equivilent of comparing caviar to the price of eggs.
In your argument, you have claimed that he who lies is not morally clean. Therefore, I pose this question to you - aren't we all morally blameworthy then? Haven't we all lied at least once in our lives? Wouldn't that tarnish our moral status? This is just to show how absurd it is to argue on such a basis.

Guess what. Now the independent media will do it's best to show that JPO was innocent or else they will put everything under the carpet in order not to make the government blush.
What did JPO do wrong? What diffeence does it make if the Mistra valley is built in the form of a disco or party area? How come the developer wanted to develop an area but MEPA insisted that the the developer should build double that? What has convinced the MEPA officials to approve such permits? But most of all why did JPO say that he knew nothing of the prject when there is clear evidence that he had signed the permit application and also rented the land for tousand of euros annually?
Please JPO reply to all this and maybe the editor might consider asking these questions to JPO himslef and how as green parliamentarian he was involved in the destruction of suah a pristine valley.

My, my, what a surprise! JPO not to be charged with anything after weeks and weeks of research. Ok, so he did not commit a crime, but, how does he stand in moral judgement? Can he put a hand on his heart and claim to be morally clean? That wouldn't surprise anybody either - after all, he did weep crocodile tears! Once more, the moral integrity and honesty of these islands takes a great knock - and we expect the rank and file of the Maltese and Gozitan population to be morally clean and upstanding! With such role models - who needs role models?
