Are there any penalties for site owners that do not comply with these regulations? When will they come into effect?

Non-compliance with these regulations will result in fines. For minor offences this could range from €233 (Lm100) to €1,165 (Lm500). For more serious offences this could range from €2,329 (Lm1,000) to €11,647 (Lm5,000). Should offenders fail to comply with these regulations upon being issued with a citation, they shall be liable to daily fine ranging from €58.25 (Lm25) to €116.50 (Lm50), as the Commissioner may fix, for every day the default continues from the date of issue of the citation.

These penalties will come into effect within the next few weeks. Until then Mepa staff, while monitoring the areas of high development intensity, are educating developers to implement the necessary measures as stipulated in Legal Notice 295/07 (Regulations for the Environment Management of Construction Sites.) Were developers are failing to comply within an agreed period, development is being forced to stop.
