To Joe Martinelli: When someone applies for any building permit on others land a so called B form must be filled and finally signed by the owner of the land .
Correct me if I m wrong , but this form was even shown by the media ! So whether JPO dealt with the renter or the developer he signed the B form , so he knew what was going on ! Finally not only was JPO aware but even the Prime Minister since this B form is a common procedure .

i still cannot understand how certain people speak about not commenting because police investigations are under way!! Since when? During court proceedings maybe. If anyone knows anything let him/her publish it now before the case is closed once and for all. In fact newspapers find no problems in publishing comments, whichever way. So I find it justifiable that JPO speaks, even though it is against his leader's wish. The problem is why did he not give proof of his innocence before the case went to the police e.g. on NET TV and/or Radio 101.

@Christina Borg - let's stop confusing the issues. The main point is not whether JPO will be prosecuted or not, or even if he will be found guilty of any crime - it is whether he was completely honest with the electorate and his party or not. It is whether he is credible or not. There can be many instances where a politician acts in a disgraceful fashion which does not amount to criminal behaviour. While JPO's supporters will tolerate practically anything because he holds that all-important parliamentary seat giving them the majority of seats in parliament, the rest of us are looking on at the sorry spectacle of a party which promised to wipe out the environmental deficit, waffling away about "investigations" and "vindication" of their for former "green champion".

Do you read articles like those of DCG, ABC and posts like those of Christina Borg, RJ Costigan, Gerard Mangion and so on? To accuse someone else of hatred first look around your comrades.
We all demand the truth about this case. However no-one can deny the facts regarding the involvement of JPO in this case. But since he is a PN MP then he has to come out clean in some way or another, no matter what (otherwise perhaps he can topple the government). For the PN & it's apologists, we don't need land like Mistra to be natural but we need to promote further people like JPO who can do whatever they want in this country. @ JPO: Please note that there are recordings of you saying that you knew nothing about it. All the documents show differently from what you have claimed in here.
@ all PN apologists: I think Labour has to right to enquire about this case. The arrogance reached by the PN and supporters is unbelievably sky high. With your attitude it clearly shows we are quickly shifting to a dictatorial state where no-one can speak unless in favour of government. So all MLP supporters should shut up criticising this benevolent government.
@ everyone: In the MLP there is currently a restructuring process going on including the leadership elections and so on. To my knowledge it is done in the most democratic way, where everyone has his say, then it's up to the voters to decide whom to choose. But for many democracy is described as "battering" or "divisive".

Regarding this case, I hope MLP and others keep making pressure as we were ending up with a raped piece of a natural land while JPO (the green man of the year) ends up with 20million euros in the pocket. Oops sorry that's what we voted for.!!!

The Mistra scandal seems to be spawning yet another scandal. Why do the law enforcement authorities or whoever is responsible give us the impression that they are dragging their feet on this case. The general perception amongst people of goodwill is that every effort is being made to sweep it under the PN's thick carpet. Another case of "Flimkien kollox possibli"?

You rightly criticise Alfred Sant for not having the guts to face JPO, even though the facts were all on his side. However my crticism is not aimed at any character flaw of JPO, but on the manner he clearly attempted to develop part of our natural heritage into an open air disco. Protecting such individuals will only encourage further abuse in future. How you fail to see this baffles me.

So one of your frequent contributors, typical of his times, believes that the police in Malta are subject to manoeuvring. Why? Because for this reader, seven weeks are more than enough to finish a thorough investigation on the Mistra case.

Apart from the fact that during these times the Attorney General had the responsibility of Malta’s hunting case in front of the European Court of Justice and God knows how much more work, when is length of time a sole criteria for a job well done? Had the investigation been concluded in a short time, your reader would probably have said that it was a whitewash as one cannot conduct a thorough investigation in a few weeks.

Let’s summarise MLP’s logic on this issue:

1. MLP thought that PM would not refer case to Commissioner of Police (COP). Alfred Sant makes a press do on the issue, just to find that PM had already referred case to Commissioner of Police;
2. MLP criticise PM for not making it public that he referred case to COP, not realising that the police need to be able to do their work without the manoeuvring of public pressure and the media;
3. While the police do their work, MLP officials and MLP media, on a daily basis, publiSH ‘leaks’ from the police investigations, and repeatedly report that police are about to move charges against a number of people;
4. At the same time, they carefully protect from such media hype, a close associate of the MLP involved in the case;
5. If the police move charges on this case, MLP will say “we were right”. If they don’t, MLP will say “it is a whitewash”.

As a DNA defected individual, I can never beat this logic.

Rarely does a political party take three months to elect a successor following the resignation of its leader. I wonder whether these three months may also be interpreted by your readers as “lending themselves to manoeuvring”.

Who gave JPO an express Press card? Who supported JPO..in these goings on...before the election and would still do the same as long as election is won?

It is now more than seven weeks since the police started "investigating" this scandal. More - much more - than enough time to conclude.

The fact that we have heard nothing yet means that there something very damaging for the Government and the PN in the results of the investigation. Two and two always make four.

What is worrying is that the police seem to be lending themselves to this maneouvering.

David Magro, if you had followed the case from the start you would have realizes that the 'renter' of JPO's property and the 'applicant for a development permit' are two different persons. Dr. JPO dealt with the renter not the developer. Knowing what the developer applied for does not make JPO a partner in any permit irregularity.
The best thing is to wait for the final outcome since coming to conclusions (the MLP way) at this stage is presumptuous to say the least.

The documents proving JPO knew about the case all along have already been spread all over the news. Thus claiming that he knew nothing about the manner in which his property was being planned for development is ridiculous. He has just stated in a comment below that he never claimed he 'knew nothing' about the case. I m sure this marry go round of claims and counter claims (on the part of JPO) may convince the more blinkered of nationalist supporters, but it will never hold up in a court of law. He should resign while he still has some semblance of honour.

If I had property to hire, even though that I am not a lawyer, a dentist or a doctor, I would set the terms and conditions, vet the details of the contract before I go on with the deal. The income that I would be receiving is not everything ! If I do not follow this procedure, I would be giving away my possession irresponsibly and my children would damn me when I die ! I do not expect a person who is in the Parliament to go forward and hire his property without vetting the contract. If this is the case, then God help Malta !!!

The JPO case has brought out one major political issue for whoever wants to see it. The MLP sees itself as the judge and arbitrer of every issue. Courts and police do not exist for the MLP. It is up to them to decide who is guilty or who is innocent. The way they have approached and still are approaching the JPO case is totally UNDEMOCRATIC!! Imagine if they were in power. I sincerely hope that there aren't any Maltese who might for one second think, that Labour can ever change.

I wonder Why, when Dr Pullicino Orlando went to the PBS, to make only Two simple Questions to Dr Sant at the press conference on the Mistra Case, Sant was so confused to answer J.P.O the two simple Q's ???. He shouldn't have run away like that, as if he Sant could have have incriminated himself. Had Dr Sant accepted J.P.O's questions, this Mistra case would not have remained so mysterious and maybe the mlp could have had won the election, if there was at least one micro truth about J.P.O' s Mistra big deal.

I'm not going to comment on the JPO case ... I'll let police investigations take their course. The spin off (pun intended) I will discuss is Labour's attitude to guilty as charged but don't try to defend yourself as innocent. I refer to the short period Labour was in power the famous 22 months. I like many others received 'fake' court judgments in absence for alleged parking fines. Sealed signed and delivered to pay without question. The people spoke their minds in the last election and will speak again in the next. My useless advice to all members of Parliament is listen to the people and remember you are to serve and not be served. I said useless advise because it will fall on deaf ears and history will repeat itself

This is a quote taken from a 'Talking Point' entitled 'Street Corner Gossip' which I wrote and the Times published on 1/3/08. I declared I knew about the application which the Labour Party attacked me with (which is simply a paved area and a stand less than two metres high with wooden flooring and with a capacity of a few hundred people-not thousands as claimed by Dr. Alfred Sant) before Alfred Sant held his famous press conference at Mistra after he had given me the slip in Gozo. How some people can persist in saying that I said I knew 'absolutely nothing' is beyond me.

We are nearly ending the month of April 2008 . For two whole months many comments on the mistra case have lead to nothing but speculation.
1. FACT - Police investigations are not concluded - we are still waiting .....does it really take so long may I ask ?

2. What is most clear, beyond any doubt, is MLP knew beforehand about this issue and chose to use the spin valley mistra case as a last minute tool to discredit PN before the elections together with all the other alleged corruption comments.
To a certain extent it did work but it was not enough for an MLP victory.

3. If the police investigations outcome result in any persons involved found not guilty of wrong doing, than whoever is responsible for instigating such allegations must pay the price in court.

4. If on the other hand persons are found guilty of scandal or character assassination or false allegations they do not deserve to represent anyone in parliament and here I am referring to both sides of the house .

What JPO and his "defensive lobby" are missing here is that this issue has two points to clarify:
(a) whether there was any corrupt practices of any kind involved
(b) whether he was HONEST with the public and HIS party leader, or whether he lied.

As regards point (a) for all that matters he may well not be found guilty beyond any reasonable by the court especially since corruption is very difficult to prove in legal terms BUT as regards point (b) he surely can`t claim that it will vindicate his position and that of the party before the election (which was a one-man party at that time) ... because it is pretty obvious that from his version on day one, the one that he knew absolutely nothing, to the public crying one, to what then came to public knowledge (the signed contract by JPO, the obligation to the investors to invest a certain amount in property on the land otherwise the contract will be void, the rent he already received, the fact that after 15 years all the property on that land will be his, what has to be built on the land such as the disco, etc ) he can`t say that he didn`t know anything....

SO .... is JPO guilty of corrupt practices ? We don`t know at the moment
Can JPO claim that he didn`t lie to and deceive the party, leader and public ? ABSOLUTELY NO.

So please, dear JPO, do not try to shift the focus on just one thing. The police are investigating whether you are corrupt or not ..... the fact that you DID NOT SAY THE TRUTH CANNOT BE DENIED !

The extent of high-Euro land developer Jeffrey Pullicino Orlando's behavior might become the biggest scandal in decades, but to clear the air the PN strategists are trying to grapple the situation with the slippery equation that includes ignorance of the full facts and legalities.
The harm in political corruption cases is that public officials who ... are hired by all of us, elected by all of us, paid by all of us, and who take an oath to act in the public's interest are taking payola to act in a certain way.

The Mistragate Affair is not necessarily about corruption and illegalities,those can only be proved in the court room. It's about public confidence. JPO was awarded the noble title of 'The green politician of the year'. He leased a piece of land in a very sensitive environmental area for pittance and let it for a profitable sum fully aware of the massive negative impact on the environment. Even if that was the beginning and end of story,it is a betrayal of trust which effected the public confidence and should therefore resign. No more no less.

..the Police Commissioner is a 'paraventu' to Sant... JPO already knows the police verdict ... JPO is putting pressure on the Police force.....and conspiracy theories galore... This is just because a man states that he is absolutely certain of his innocence! Whether he really is or not, no one knows except he at this point in time.

Why does the MLP make such a big fuss about a man who jumps up in his own defence whenever he is cornered to do so? Is it an attempt at deviating attention from the colourful saga the MLP is going through at the moment? Does the MLP want JPO to fold down and bow out without a struggle as ex-NSO director Cordina did when hounded on a daily basis? Perhaps JPO, being a hardened politician, has acquired a lot more stamina to rebut arrow volleys without caving in so quickly. I honestly cannot understand the MLP's actions in this affair. Can't they understand that they are only managing to shift the thinking voter's focus on their antics instead of on JPO's doings or alleged wrongdoings?

This has to be ONLY IN MALTA....first you have a party in opposition and its media accusing and assume wrongdoing and asks for confirmations prior and post elections.....then....the moment the defendant opens his mouth, the same party claims foul and states that this is "....unacceptable pressure......" on the police investigation !! In maltese we ask : TAFU XI TRIDU ?? (What do you really want ?) It is obvious that any person is innocent until proven guilty !!! or does the MLP beleive that any citizen is guilty unless proven innocent ?

What H Farrugia doesn t seem to realise, is that the JPO affair concerns all of us, including himself. By taking the Nationalist party media line on such issues (which appears to be to attack the critics with irrelevant issues), he is merely illustrating his lack of self judgement and free thinking. Dear all,
Prior to police investigations and prior to March 8 JPO had all the possibilities to air his views and proof on his party's TV and Radio stations i.e. NET TV and Radio 101. It would have saved a lot of allegations, especially the one of mud-slinging. Why this was not done immediately is a mystery and shall probably remain so. It is very difficult, now that so much time has passed and that certain information might have been lost, to persuade many about mud-slinging or not. As happens usually with such things, many people's minds are made up. It would be a real pity that people start doubting also police investigations. One thing is certain - a permit to construct at Mistra was issued. Who is going to shoulder the responsibility? Ghosts? People need to see justice prevail.

To any reasonable man/woman that statement doesn't sound like he is TRYING "to vindicate his innocence once the police inquiry is concluded." It means that he already knows the outcome of the police investigations which gives rise to the POSSIBLE claim (but not definite since Dr. Pullicino Orlando may be trying to fight the battle to the end) that he knows exactly what is going in in the investigation. Just as he apparently knew exactly was going on with the MEPA application.

Secondly, you ought to know that it is no longer the MLP who are only asking questions about this case but other politically independent establishments. The words "You're Unbelievable!" come to mind.

Mlp you'de better concentrate on your party's future instead of continuing with trying to put wool over our eyes so as not to see what is happening in your battered party. The knives that have been drawn against your same members who are contesting for the leadership, the hatred there is in your midst.
You had better concentrate on Jason, and his henchmen on super one. The people will take you more seriously if you put your house in order before telling others what to do.

Is this the reason why the mlp administration is so afraid of Gorg abela and have already put its weight behind Muscat? Shame on the MLP. You coste your supporters already three defeats in a row.

The MLP, its media and its supporters have been more than six weeks battering JPO and a couple of other people on this issue, trying to exert public pressure on the Police and the Office of the Attorney General. Now they come out with this statement. Unbelievable … what cheek!

JPO said that he will only try to vindicate his innocence once the police inquiry is concluded. The MLP, its media and its supporters have been claiming JPO is guilty every single day since PM Gonzi referred the case to the Police Commissioner and the MEPA Auditor. They also went so far as to mention a couple of other people together with JPO against who police charges would allegedly be brought, and all this when the police investigation is still on.

Shame on MLP and its strategy to use its media as prosecution, judge and jury.
