A company that had been involved in a case over counterfeit money yesterday filed an application in court requesting a re-trial, claiming that the Court of Appeal had wrongly interpreted the law.

The application was filed by La Piazza Ltd in the acts of the case it had filed against Bank of Valletta.

The case dates back to October 1997 when the company requested the bank to authenticate $40,200 in $100 dollar notes. After receiving the necessary go-ahead, the company went on to cash the notes but two days later, the bank debited the company's account claiming that the cash was counterfeit.

The First Hall of the Civil Court had, in October 2005, ruled in favour of the company and ordered BOV to pay the amount.

However, the Court of Appeal last June ruled in the bank's favour.

In its application, the company is requesting a re-trial claiming that the Court of Appeal misinterpreted the law.

Lawyer David Farrugia Sacco signed the application.
