The Industrial Tribunal has ruled that an employer was justified in dismissing an employee who was not abiding by company regulations.

Mario Azzopardi claimed that Entertainments Ltd had dismissed him unfairly. But the company said Mr Azzopardi was dismissed after he was caught stealing and because he did not follow company regulations.

The tribunal, chaired by George Borg Cardona, heard that Mr Azzopardi, who worked as a barman, had been observed preparing drinks for customers and accepting payment without issuing a receipt. He was also seen cutting a piece of the receipt printer paper roll and putting it in his pocket.

A manager also alleged that he had been stealing money from the cash. However, Mr Azzopardi denied stealing and added that he had personal problems with the manager who testified against him. He also explained that he put the receipt paper in his pocket because he used it to write notes on.

The tribunal noted that although there were some discrepancies between the witnesses and that investigations could have been carried out in a more professional manner, the evidence showed that Mr Azzopardi did not abide by company policy and breached regulations aimed at ensuring there was no abuse.
