A 26-year-old man was conditionally discharged for three years for damaging a car when he threw garbage on it and kicked it because it was blocking his access to a skip.
Magistrate Doreen Clarke heard the prosecution explain that on August 11, 1999, Anthony Mizzi's car was parked near a TGI Friday outlet in Sliema. The car blocked access to one of the skips near the restaurant.
Investigations indicated that Christian Grixti, who worked at the restaurant, had been responsible for taking out the garbage that day.
Shoe prints found on the damaged car matched Mr Grixti's.
On evaluating the evidence, Magistrate Clarke ruled that, although the evidence was circumstantial, it was sufficient to convince her that Mr Grixti had damaged the car.
She noted that the incident happened practically eight years ago, when Mr Grixti was only 18. She also noted that Mr Mizzi's insurance had covered the damage caused and that Mr Grixti had a clean criminal record.
Police Inspector Francis Micallef prosecuted.
