The Marsascala local council and members of the committee against the proposed upgrading of the Sant'Antnin recycling plant yesterday filed a sworn application claiming that a decision by Mepa's board last December was null as the principles of natural justice had not been observed.
The local council and the committee members noted that on December 21, 2006, the Mepa board had approved the full development permit for proposed changes to the plant. They argued that Mepa had failed to observe the principles of natural justice during the December 21 meeting for various reasons. One committee member had not been informed about the meeting and another was not allowed in on grounds there was no space.
Apart from that, Catherine Galea, who chaired the board, had failed to declare her conflict of interest as would result later on, they said.
For these reasons they called on the court to declare that Mepa's actions, in approving the application, were null and void.
Lawyer Owen Bonnici signed the application.
