A court yesterday put the blame on a pedestrian for an accident in Mosta in which he was run over by a car.
On November 18, 2004, Marco Micallef was hit in Constitution Street by a car driven by Beatriz Zarb, who was cleared of the charges brought against her.
Doctors had operated on Mr Micallef for six hours and he spent six days recovering in hospital. Magistrate Silvio Demicoli told Mr Micallef that he had put himself in danger when crossing the road between two parked cars a couple of metres away from a zebra crossing.
Magistrate Demicoli referred to case law involving George Micallef pro et noe vs Gordon Camenzuli, dated June 21, 1995.
In that case the court had noted that a pedestrian should cross a road from a subway or a zebra crossing and this when both ends of the road are visible to the pedestrian.
Inspector Raymond Cassar prosecuted.
