A 23-year-old man was yesterday cleared of assaulting a man and his son and slightly injuring one of them after a magistrate ruled that the prosecution had failed to prove its case.

Ludwig Dimech had been charged with assaulting Dennis Farrugia and his son Wayne and slightly injuring Dennis Farrugia in Zebbug on May 18.

Magistrate Consuelo Scerri Herrera heard how the incident took place when the Farrugias went to Mr Dimech's house because his father owed them money.

Mr Dimech claimed that Dennis Farrugia took out a gun and even hit him with it but the Farrugias denied having a gun and said Mr Dimech had assaulted Dennis Farrugia.

On examining the case Magistrate Scerri Herrera noted that the prosecution had failed to produce the witnesses to prove its case and cleared Mr Dimech.

Police Inspector Jesmond Borg prosecuted.
